REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 5, 2007 <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2006-23 TO <br />ALLOW AFTER HOURS OPERATIONS AND <br />CONDITIONAL USE PERMIT NO. 2006-24 TO <br />ALLOW PARKING IN THE R2-B ZONE FOR A <br />PROPOSED WALGREENS AT 1715 NORTH BRISTOL <br />STREET - EVE~GR~EN DEVCO, APPLICANT <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 15f Reading <br />^ Ordinance on 2nd Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. <br />2006-23 as conditioned Conditional Use Permit No. 2006-24 as conditioned. <br />PLANNING COMMISSION ACTION <br />On February 12, 2007, the Planning Commission approved and adopted the <br />Mitigated Negative Declaration and Mitigation Monitoring Program, <br />Environmental Review No. 2005-208; adopted a resolution approving <br />Conditional Use Permit No. 2006-23 allowing operations between the hours <br />of 12:00 midnight and 5:00 a.m. as conditioned; and adopted a resolution <br />approving Conditional Use Permit No. 2006-24 allowing parking in the <br />portion of the site that is zoned two-family residence with a B suffix <br />(R2-B) as conditioned by a vote of 7:0 for a proposed Walgreens at 1715 <br />North Bristol Street (Exhibit A). The Planning Commission added a <br />condition to install decorative driveway approaches on the Bristol and <br />Seventeenth Streets entrances to create visual consistency with the <br />development across Bristol Street. In addition, the Planning Commission, <br />in concurrence with the Police Department, removed Police Department <br />condition No. 13J of CUP 2006-23, which required the installation of <br />audio recording component of the closed circuit television system at the <br />public counter. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. <br />Jay M.
