<br />AA No. 07-01, EIR No. 06-01, <br />GPA No. 07-01, ZOA No. 07-01, <br />DA No. 07-01, SPR No. 07-1 and TTM No. 07-01 <br />March 19, 2007 <br />Page 12 <br /> <br />Tentative Tract Map <br /> <br />Since the First and Cabrillo development is an exclusively for-sale <br />proj ect, the applicant is requesting approval of a tentative tract map <br />for the project (County Map No. 17069) for condominium purposes. Based <br />on a review of the tentative map by the Planning Division and Public <br />Works Agency, the project has been designed to be in compliance with the <br />applicable development standards found in Chapters 34 (Subdivision) and <br />41 (Zoning) of the Santa Ana Municipal Code as well as the proposed Metro <br />East Mixed Use overlay zoning document. <br /> <br />Approval of the tract map will be consistent with the goals and policies <br />identified in the City's General Plan. Policy No. 1.3 of the General <br />Plan Land Use Element encourages high-density residential development <br />within the City's District Centers. Further, Policy No. 1.4 promotes the <br />maintenance and fostering of a variety of residential land uses in the <br />City (Exhibit 16). <br /> <br />Site Plan Approval <br /> <br />Finally, the applicant is requesting site plan approval for the project. <br />Pursuant to Section 2 of the Metro East Mixed Use Overlay Zone document, <br />the Planning Commission is required to review and approve all plans for <br />development within the Metro East area to ensure the project is in <br />conformity with the MEMU Overlay Zone standards. The review ensures that <br />the buildings, structures and grounds are in keeping with the <br />neighborhood and will not be detrimental to the development of the MEMU <br />area. <br /> <br />The project is located within the Active Urban District of the proposed <br />overlay zone. As such, specific design standards were developed for <br />projects within this area. After analyzing the project, staff has found <br />that the project will be in compliance with all applicable standards of <br />the proposed Metro East Mixed Use Overlay Zone and the Metro East Public <br />Realm Plans, including height, lot size, open space and parking. The <br />proposed project is proposing to provide a 45-foot front yard setback, a <br />24-foot side yard setback and a rear yard setback of 25-45 feet. <br />Although the setback standards for the District range from zero to 20 <br />feet, the project is consistent as a larger setback is permitted if it is <br />used as a public open space, dining/gathering area or special entry area. <br />Since retail space is proposed along First Street and Cabrillo Park Drive, <br />the increased setback is consistent with the plan. Further, the rear yard <br />setback is consistent with the plan as the northern portion of the site <br />will be dedicated to the City for use as a public pedestrian alley. <br /> <br />758-12 <br />
