<br />AA No. 07-01, EIR No. 06-01, <br />GPA No. 07-01, ZOA No. 07-01, <br />DA No. 07-01, SPR No. 07-1 and TTM No. 07-01 <br />March 19, 2007 <br />Page 13 <br /> <br />Airport Land Use Commission <br /> <br />In accordance with State law, the building height for the two towers (262 <br />feet above grade) and the project's proximity to the John Wayne Airport <br />required the project to be submitted to the Airport Land Use Commission <br />(ALUC) for a determination of consistency with the Airport Environs Land <br />Use Plan (AELUP) for John Wayne Airport. To comply with this mandate, the <br />City referred the project to the ALUC on February 27, 2007 and is on the <br />March IS, 2007 ALUC meeting agenda. In the event that the ALUC makes a <br />determination of consistency for the project, any conditions of approval <br />resulting from this determination may be incorporated as conditions of <br />approval for this project. <br /> <br />In conjunction with the ALUC application package and review, the Federal <br />Aviation Administration (FAA) made a determination on January 1, 2007 that <br />the First and Cabrillo project poses no hazard to air navigation. <br /> <br />Planning Commission Actions <br /> <br />On February 26, 2007, the Planning Commission held a public hearing on <br />the Metro East Mixed Use Overlay Zone and the First and Cabrillo Towers <br />projects. After extensive discussion regarding both items, the Planning <br />Commission recommended approval of the environmental impact report <br />(Volume I), the zoning ordinance amendment and the general plan amendment <br />for the overlay zone. The recommendation was based on the Commission's <br />desire to encourage a mixed-use, higher density, pedestrian friendly <br />environment in the east area of the City. However, the Commission <br />continued the items related to the First and Cabrillo Towers since the <br />negotiations on the development agreement had not been completed. The <br />Commission requested that all items regarding the towers project be <br />presented at one time and allow a comprehensive review of all actions by <br />the Commission. <br /> <br />On March 12, 2007, the Planning Commission held a second hearing on the <br />project. At this hearing, staff reviewed the development agreement with <br />the Commission, including the pertinent deal points. At the conclusion <br />of the hearing, the Commission recommended that the City Council approve <br />the First and Cabrillo development agreement. <br /> <br />Conclusion <br /> <br />The Metro East Mixed Use Overlay Zone and the First and Cabrillo Towers <br />Project represent a continuation in the urban evolution of the City of <br />Santa Ana.
