<br />CITY OF SANTA ANA POLICE DEPARTMENT <br />Agreement Number 06.7595 <br />Page 4 of 4 <br /> <br />EXHIBIT D (Con!.) <br />(Standard Agreement) <br /> <br />SPECIAL TERMS AND CONDITIONS <br /> <br />Employee Benefits. (Applies Only to Janitorial and Security Guard Services) The Contractor shall comply <br />with Government Code (GC) section 19134, which requires Contractors to provide employee benefits that are <br />valued at least 85% of the state employer cost of benefits provided to state employees for performing similar <br />duties. Employee benefits include health, dental and vision. The benefit rate is published by the Department of <br />Personnel Administration (OPA) February 1" of each year and is effective until January 31" of the following year. <br />Contractor may either provide benefits as described above or cash-in-lieu payments for each hour of service <br />employees perform on the covered state contract (excluding overtime). Failure to comply with the provisions of <br />GC S 19134 will be deemed a material breach of this contract, which may result in contract termination at the <br />state's sole discretion. Contractor may access rates and information at ww_w,QJ:>jl&;l,R()\I', <br /> <br />THIS AGREEMENT IS OF NO FORCE AND EFFECT UNTIL SIGNED BY BOTH PARTIES <br />AND APPROVED BY THE DEPARTMENT OF GENERAL SERVICES, IF REQUIRED. <br />CONTRACTOR MAY NOT COMMENCE PERFORMANCE UNTIL SUCH APPROVAL HAS <br />BEEN OBTAINED AND ANY COMMENCEMENT OF PERFORMANCE PRIOR TO <br />AGREEMENT APPROVAL SHALL BE DONE AT THE CONTRACTOR'S OWN RISK. <br />
