e. Obtain defective products and/or other evidence, and hold if at all possible or at <br />least locate where such products are being held and obtain product information for t <br />file. <br />£ Utilize experts appropriately in cases. <br />g. Maintain membership in Claims Index Bureau; provide the Bureau with updated <br />indexing information as applicable; and make inquiries on claims when an index <br />match occurs. <br />h. Arrange appraisals for damaged property. <br />i. Timely report to BICEP and all insurers that potentially provide insurance <br />coverage. <br />9.2. Tort Claim Requirements. The MEMBER shall give all notices (pertaining to claims <br />insufficiency, returning late claims, claims rejections) in accordance with applicable law. <br />9.3. Documentation: <br />9.3.1 The MEMBER shall establish reasonable reserves based upon facts known, <br />within thirty (30) days of receipt of investigative report, with expenses included. Th. <br />reserves shall reflect the MEMBER'S potential exposure to claimant's attorney fees, <br />costs and interest, if applicable. The MEMBER shall monitor reserves for adequacy <br />throughout the life of the CLAIM and modify them as needed. <br />9.3.2. The MEMBER shall maintain a claim file on each CLAIM against the <br />MEMBER or its EMPLOYEE. <br />9.3.3. The claims files shall contain documentation necessary to support the <br />decisions made with respect to disposition of CLAIMS. <br />9.3.4. Photos, diagrams, plans, contracts, medical and law enforcement reports, <br />reports of investigation, attorney reports and other relevant documents shall be <br />deposited in the claim file in a timely fashion. <br />9.4. Requirements for Written Reports from MEMBER'S defense attorney after the <br />MEMBER has placed BICEP on notice of a CLAIM or OCCURRENCE. <br />9.4.1. The MEMBER shall provide its outside defense attorney(s) with copies of <br />attached (a) BICEP Defense Attorney Reporting Requirements and (b) BICEP <br />Litigation Plan and Budget. <br />9.4.2. The MEMBER has the responsibility of ensuring that its outside defense <br />attorney(s) complies with BICEP's reporting and budgeting requirements. <br />9.4.3 If the City Attorney Office serves as lead defense attorney, it shall provide <br />BICEP with the Preliminary Evaluation described in Section I of the attached B[CEP <br />Defense Attorney Reporting Requirements.
