be required only to copy BICEP with its internal status and evaluation reports. <br />9.4.4. These requirements apply regardless of whether or not there is a coverage <br />controversy between BICEP and the MEMBER. <br />9.5. DEFENSE COSTS. <br />9.5.1. Upon giving notice to BICEP of a CLAIM or OCCURRENCE, the MEMBER <br />shall require its outside defense attorney(s) to provide the BICEP Claims <br />Administrator with copies of monthly billings for attorney fees and other DEFENSE <br />COSTS. <br />9.5.2. The MEMBER'S risk manager or claims manager shall keep a current ledger <br />of payments of outside attorney(s) fees and other DEFENSE COSTS, and shall <br />provide it to BICEP's Claims Administrator upon request. <br />9.5.3. The City Attorney Office will not be required to submit a monthly record of <br />DEFENSE COSTS. However, it must keep a current record documenting them. <br />9.6. Settlement <br />9.6.1. Once the MEMBER gives the notice required by section 6 of the <br />Requirements, BICEP shall have the right to negotiate a settlement directly with the <br />claimant or plaintiff, subject to the MEMBER'S approval of the settlement. <br />9.6.2. If the MEMBER declines to accept a settlement that BICEP recommends, <br />BICEP's liability will be limited to the amount specified in Section III of the BICEP <br />MEMORANDUM OF COVERAGE. <br />9.6.3. The MEMBER'S defense attorney(s) shall provide BICEP with fully executed <br />releases, settlement agreements and, when appropriate, court endorsed copies of <br />dismissals and satisfactions of judgment. <br />10.0. DEFAULT. <br />10.1. No MEMBER that substantially complies with these Requirements maybe found in <br />default. <br />10.2. BICEP shall furnish the MEMBER with written notification of the MEMBER'S <br />failure to comply with these Requirements. <br />10.3. The MEMBER shall furnish a written response outlining a program for corrective <br />action, or showing that it has substantially complied with these Requirements, within thirty <br />(30) days of receipt of BICEP's notification. <br />10.4. If BICEP approves corrective action, the MEMBER shall implement the approved <br />program within sixty (60) days of notice of such approval. <br />03-OS-06 19 <br />
