INSURANCE ON FILE <br />WORK MAY PROCEED A- 2006 - 118 -01 <br />UNTIL INSURANCE EXPIRES <br />FIRST AMENDMENT TO AGREEMENT <br />CLERK Of COUNCIL <br />DAZE: it' i9 -07 THIS FIRST AMENDMENT, made and entered into this 20 day of May, 2007, by and <br />0' r-t4x5 between the CITY OF SANTA ANA, a charter city and municipal corporation duly organized <br />p l) and existing under the Constitution and laws of the State of California ( "City ") and NAES <br />�Offi' Acquisition Corp, dba Amtech Elevator Services, a California corporation ( "Contractor "). <br />RECITALS <br />A. The City and Contractor entered into Agreement, A- 2006 -118, dated May 15's 2006, <br />hereinafter referred to as "said Agreement ", by which Contractor has provided <br />maintenance, service and repair of elevators located within City facilities. <br />B. The parties now desire to extend the term of said Agreement and authorize an additional <br />one year of funding in order to provide continuous service under said Agreement. <br />WHEREFORE, in consideration of the mutual and respective promises hereinafter <br />contained and made, and subject to all the terms and conditions of said Agreement as hereby <br />amended, the parties do hereby agree as follows: <br />1. Section 2, of said Agreement, pertaining to Compensation is hereby amended to provide an <br />additional $30,816.00 to fund services provided during the extended term from June 1, 2007 <br />through May 31, 2008. <br />2. Section 3, of said Agreement, pertaining to Term is hereby amended to extend the termination <br />date for an additional one -year term, through May 31, 2008. <br />3. Except as modified by the two amendments, the terms and conditions of said Agreement <br />remain unchanged and in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to said <br />Agreement on the date and year first above written. <br />ATTEST: <br />PATRICIA E.
