THIRD AMENDMENT TO AGREEMENT <br />A-2006.-~ 18-03`' <br />'q THIS THIRD AMENDMENT, made and entered into this 1St day of April, 2009, by and <br />between the CITY OF SANTA ANA, a charter city and municipal corporation duly organized <br />~: '; and existing under the Constitution and laws of the State of California ("City") and NAES <br />~ ~ Jam'' Acquisition Corp, dba Amtech Elevator Services, a California corporation ("Contractor"). <br />u..UU Z <br />g faL cc O <br />~-~ ~ ~ RECITALS <br />zQ ' ~ v1V~ <br />~~ <br />~ Y -' ~ LL' A. The City and Contractor entered into Agreement, A-2006-118, dated May 15th 2006, <br />~c~cF wr <br />z ~ ~ ~ c hereinafter referred to as "said Agreement", by which Contractor has provided <br />~--. maintenance, service and repair of elevators located within City facilities. <br />~ B. The City now desires to exercise its option to extend the term of said Agreement and <br />authorize an additional one year of funding in order to provide continuous service under <br />~ said Agreement. <br />`~_'. ~ WHEREFORE, in consideration of the mutual and respective promises hereinafter contained and <br />~~ to made, and subject to all the terms and conditions of said Agreement as hereby amended, the <br />,S parties do hereby agree as follows: <br />~. 1. Section 2, of said Agreement, pertaining to Compensation is hereby amended to provide an <br />.. - ~ additional $30,816.00 to fund services provided during the extended term from June 1, 2009 <br />fJ ' through May 31, 2010. <br />2. Section 3, of said Agreement, pertaining to Term is hereby amended to extend the termination <br />date for an additional one-year term, through May 31, 2010. <br />3.
