Thc CITY, as an entitlcmcnt rccipicnt and grantcc of the Unitcd Statcs Dcpartmcnt of <br />Housing and Urban Devclopmcnt ("HUD") Community Developmcnt Block Grant ("CDBG") <br />Program, dcsircs to cntcr this Agreemcnt with the SUBRECIPIENT for thc cxpcnditurc of CDBG <br />funds in accordancc with Titlc 24, Part 570 of Code of Fedcral Regulations 24 CFR 570.000, ef seq. <br />("CDBG REGS"); and <br /> <br />B. CITY has applicd for and rcccivcd CDBG funds from HUD pursuant to Titlc I ofthc <br />Housing and Community Dcvelopmcnt Act of 1974, Public Law 93-383, as amcndcd ("ACT"); and <br /> <br />C. Thc SUB RECIPIENT is a privatc nonprofit agcncy that has bccn selectcd by thc CITY <br />to rcccivc CDBG funds and administcr such financial assistancc; and to providc thc scrviccs <br />dcscribcd in Exhibit A, in accordance with the schcdule ofperformancc includcd thcrcin, hcrcinaftcr <br />rcfcrrcd to as "said program". SUBRECIPIENT rcprcscnts that it is qualificd and willing to opcratc <br />said program and ccrtifics that thc activitics carricd out with funds providcd undcr this Agrccmcnt <br />will mcct onc or morc ofthc CDBG program's National Objcctivcs (24 CFR Part 570.208). <br /> <br />D. SUBRECIPIENT agrecs that it will adhere to thc pcrformancc mcasurcmcnts and <br />outcomcs as indicatcd on Exhibit A-I (Outcomc Tracking). Failurc to follow thc mcasurcmcnts <br />and mcct thc statcd outcomcs may constitute brcach of contract that could rcsult in tcrmination <br />of this Agrccmcnt or scrvc as rcason for the City to rccapturc thc grant funds awardcd to <br />SUBRECIPIENT pursuant to this Agrccmcnt. <br /> <br />E.
