<br />5'05 <br /> <br />If any funds othcr than Fcdcral appropriatcd funds havc becn paid or will bc paid to <br />any pcrson for influcncing or attcmpting to influcncc an officcr or cmploycc of any agcncy, a <br />Mcmbcr of Congrcss, an officcr or cmploycc of Congrcss, or an employec of a Mcmbcr of <br />Congrcss in conncction with this Federal contract, grant, loan, or coopcrative agrccmcnt, thc <br />undcrsigncd shall complctc and submit a "Disclosurc Form to Report Lobbying," in accordancc <br />with its instructions (sce C- I). <br /> <br />T. Financial Intcrest. SUBRECIPIENT a!,TJ"ccs that except for thc usc ofCDBG funds <br />to pay salarics and other related administrativc or pcrsonncl costs, no pcrsons who cxcrcise or havc <br />cxcrciscd any function with rcspcct to CDBG activities assistcd under the tcrms of this Agrecmcnt, <br />or who are in a position to participatc in a decision-making process or gain inside information with <br />rcgard to such activities, may obtain a financial intercst or bencfit from a CDBG-assisted activity of <br />SUBRECIPIENT, cithcr for themsclves or thosc with whom thcy havc family or business tics, <br />during thcir tcnure or for one year thcrcaftcr. This prohibition applies to any person who is an <br />cmploycc, agcnt, consultant, officcr, or clcctcd or appointed official of CITY, or of <br />any dcsignatcd public agcncies, or the SUBRECIPIENT. <br /> <br />U. Davis-Bacon Act. Alllaborcrs and mcchanics cmploycd by contractors or <br />subcontractors in the pcrformancc of construction work, including altcrations and rcpairs, in cxccss <br />of $2,000.00, financcd in wholc or in part with fedcral funds shall bc paid wagcs at rates not Icss <br />than thosc prcvailing on similar construction in the locality as dctcrmined in accordance with thc <br />Davis-Bacon Act, as amcndcd, 40 USe. scctions 276a - 276a-5. A brcach of thc contract <br />clauscs in 29 C.F.R. 95.5 may bc grounds for tcrmination of thc contract, and for dcbarmcnt as a <br />contractor/subcontractor, as providcd in 29 e.F.R. 95. I 2. The unlawful manufacture, distribution, dispcnsing, posscssion or usc of a <br />controllcd substancc is prohibitcd in the workplacc for any cmployce involved in a fcderally fundcd <br />program. <br /> <br />2.
