<br />APPENDIX B <br /> <br />CITY'S STANDARD CONSULTING AGREEMENT <br /> <br />TESTING AND INSPECTION SERVICES <br /> <br />FOR CITY OF SANTA ANA <br /> <br />CAPITAL IMPROVEMENT PROJECTS <br /> <br />THIS AGREEMENT made and entered into this day of <br />2007, by and between <br />("CONSULTANT") and the City of <br />Santa Ana, a municipal corporation of the State of California <br />("CITY") . <br /> <br />WITNESSETH <br /> <br />Recitals: <br /> <br />A. CITY desires to retain a professional firm having skill <br /> <br />and knowledge of material testing and construction inspection <br /> <br />services for the construction of the Annual Capital Improvement <br /> <br />Projects. <br /> <br />WHEREFORE, in consideration of their mutual and respective <br />promises, and subject to the terms and conditions hereinafter set <br />forth, the parties hereto do hereby agree as follows: <br /> <br />1. REPRESENTATIVES AND NOTICE <br /> <br />A. For purposes of implementing this Agreement, the <br />representa ti ves of CITY shall be the Executive Director of the <br />Public Works Agency and his designated representatives (the <br />"Director") and the representative of CONSULTANT shall be the <br />Vice-President. Except as may be otherwise stated hereinafter, <br />such representatives shall have the authority to act on behalf of <br />their respective parties in carrying out the terms of this <br />AGREEMENT. <br /> <br />- 11 - <br />
