Any notice or instrument required to be given or <br />delivered to either party to this AGREEMENT may be delivered by <br />personal delivery or by depositing the same in the United States <br />mail, postage prepaid, addressed to: <br /> <br />To CITY: <br /> <br />Executive Director <br />Public Works Agency <br />City of Santa Ana <br />Public Works Agency <br />20 Civic Center Plaza <br />Santa Ana, CA 92701 <br /> <br />To CONSULTANT: <br /> <br />Notice of change of address shall be delivered in the same <br />manner'as any other notice provided herein. Notice by mail shall <br />be effective three days after mailing by the above-described <br />procedure. <br /> <br />2. SCOPE OF SERVICES OF CONSULTANT <br /> <br />CONSULTf\NT agrees to perform, at its own cost and expense <br />except for the compensation specified in this Agreement, the <br />services specified in the RFP, attached hereto as "Exhibit A" and <br />"incorporated~'"herein "--by reference',"- "and "the'''Proposal,'" attached <br />hereto as "Exhibit B" and incorporated herein by reference, <br />subject to modifications as may be set forth in the text of this <br />Agreement. <br /> <br />3. STANDARD OF PERFORMANCE <br /> <br />In undertaking the performance of this Agreement, CONSULTANT <br />represents that it is knowledgeable in the field specified in <br />Recital A of this Agreement, and that any services performed by <br />CONSULTANT under this Agreement will be performed in compliance <br />with such standards as may reasonably be expected from a <br />professional consulting firm in that field. <br /> <br />- 12 - <br />
