REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 3, 2008 <br />TITLE: <br />APPEAL NO. 2007-05 (TENTATIVE PARCEL <br />MAP NO. 2007-05 [COUNTY MAP NO. <br />2006-308]) TO SUBDIVIDE PROPERTY AT <br />2727 NORTH BRISTOL STREET - RED <br />MOUNTAIN RET L, INC., APPLICANT <br />G~ CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 15' Reading <br />^ Ordinance on 2"d Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report denying Appeal No. 2007-05 (Tentative <br />Parcel Map No. 2007-05 [County Map No. 2006-308]). <br />PLANNING COMMISSION ACTION <br />On January 28, 2008, the Planning Commission denied Appeal No. 2007-05 <br />and adopted a resolution denying Tentative Parcel Map No. 2007-05 (County <br />Map No. 2006-308) by a vote of 6:0 (Betancourt absent) to subdivide a <br />property into two parcels in the Community Commercial (100-C1-10000) <br />zoning district at 2727 North Bristol Street (Exhibit A). The Planning <br />Commission upheld the recommendation of the Zoning Administrator and <br />agreed that the creation of an irregular shaped parcel would affect the <br />long term viability of the shopping center and would make it difficult to <br />develop the new parcel to the City's commercial development standards <br />which would not be a benefit to the community in the long term. <br />ZONING ADMINISTRATOR ACTION <br />On November 28, 2007, the Zoning Administrator adopted a resolution <br />denying Tentative Parcel Map No. 2007-05 (County Map No. 2006-308). The <br />applicant submitted a letter appealing this decision for consideration by <br />the Commission at their January 28, 2008 meeting. No changes were made <br />to the staff report (Exhibit B). <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. <br />Jay M.
