Therefore the services <br />we are proposing to offer are: <br />• Senior Engineers <br />• Assistant Engineer <br />• Inspectors <br />• Senior Designers <br />We are not offering the non-professional services such as <br />Administrative Assistance, CAD Drafters, or Survey <br />Technicians. <br />1.2 Overview of Public Sector Use of Temporary <br />Employees <br />Project Partners realizes that the City of Santa Ana's Public <br />Works Agency is aware of evolving California labor laws and <br />is sensitive to the fact that the proper amount of control must <br />be established over projects and involved personnel who are <br />not City employees. Recent temporary employment lawsuits, <br />specifically the ongoing MWD class action suit (Cargill vs. <br />MWD) and the much -publicized Microsoft lawsuit, highlight <br />this fact. The MWD lawsuit is particularly relevant, as the <br />case addresses contingent technical staff in a California public <br />sector organization. <br />This ongoing class action lawsuit highlights the fact that a <br />public sector agency must properly implement the use of non - <br />employee personnel or face significant risk and exposure, <br />particularly if these personnel work on site.
