• <br />O Confidential <br />services. This operational program was developed with a <br />considerable effort of both time and expense. Project Partners <br />developed the program cooperatively with the MWD Temporary <br />Lawsuit case lawyers to ensure it is comprehensive and <br />addresses all the issues raised in the MWD and other class <br />action lawsuits. These lawyers have been working on the case <br />and its related issues almost continuously for over four years. <br />Then to verify that the program would hold up to various legal <br />challenges, we validated it with law firms specializing in <br />California municipal law and State and Federal labor law. <br />The program proved itself to be solid. It is an Operational <br />Procedure that allows public sector agencies to utilize Project <br />Partners' technical expertise and assistance on -site while <br />clearly establishing Project Partners as the employer of record. <br />The program is complex and contains myriad documents and <br />control facets. Rather than fully describe our extensive, <br />situation -dependent procedures, the following subsection <br />highlights key areas of our Operational Program. <br />1.3.2 Staff Manager <br />A primary feature of our Operational Program is instituting the <br />position of Staff Manager to maintain relationships and control. <br />This position is a key cornerstone of the implementation of our <br />operations. <br />The Staff Manager facilitates the proper amount of control over <br />Project Partners' on -site employees. Project Partners will <br />designate Kimo Look to be the Staff Manager. The duties and <br />responsibilities are administrative and not billed. <br />The Staff Manager will be the key contact for project <br />discussion, clarification, and problem resolution for projects <br />undertaken by Project Partners. The Staff Manager's role will <br />include coordination with all on -site Project Partners personnel <br />on receiving all new project requests. When necessary, an <br />On -site Manager will be appointed to transmit project requests <br />to our office for evaluation and approval. <br />The Staff Manager will also work in partnering fashion with City <br />staff on maintaining a relationship that minimizes risk. <br />1.3.3 Automatic Documentation <br />Proper documentation is often key in determining labor related <br />matters, particularly in a legal setting.
