To the best of SUBRECI PI ENT' S knowledge, <br />SU BRECI PI ENT' S execution, delivery and performance of its obligations under this Agreement <br />will not constitute a default or a breach under any contract, agreement or order to which <br />SU BRECI PI ENT i s a party or by whi ch i t i s bound. <br />(e) No Bankruptcy. SUBRECI PI ENT is not the subject of any current or <br />threatened bankruptcy proceedi ng. <br />(f) No Pending Legal Proceedings SUBRECIPIENT isnot the subject of a <br />current or threatened I i ti gati on that; woul d or may materi al I y affect SU BRECI PI ENT' S <br />performance under this Agreement. <br />(g) Application Veracity. All provisi ons of and information provided in <br />SU BRECI PI ENT' S application for funding submitted to CITY i nd udi ng any exhi bits are true <br />and correct in al I material respects <br />(h) No Pending Investigation.
