The current form and versi on of such noti ce i s attached as <br />Attachment No. 2 to this Agreement. <br />(i i i) SU BRECI PI ENT shat I ensure that at I occupants, owners, and <br />purchasers of housi ng be noti fi ed i n wri ti ng of the results of the presumpti on of <br />L BP and/or L BP hazards, and results of any I ead hazard eval uati on, and any I ead <br />hazard reducti on work i n accordance wi th 24 CFR 35, Subpart A. The current <br />form and version of such notice is attached as Attachment No. 3 to this <br />Agreement. <br />(d) Lead Hazard Evaluation (24 CFR 35125). SUBRECIPI ENT shall conduct <br />all activities described in Section 35.1015 relating to visual int, paint stabi I izati on, risk <br />assessment, and mai ntenanoe with regard to al I resi denti al property that i s under its ownershi p, <br />possessi on, or control and/or res denti al property occupi ed by persons or fami I ies that recei ve <br />fi nanci al or other assi starve from SU BRECI PI ENT, except for the exemptions descri bed bel ow <br />in section 4 (d)(i)(1). <br />(i) SUBRECI RENT shall causeavisual assessment to identify <br />deteri orated pai nt i n al I resi denti al property that i s under i is ownershi p, possessi on, or control <br />and/or resi denti al property occupi ed by persons or fami 1 i es that reoei ve fi nancl al or other <br />assi stance from SU BRECI PI ENT. <br />(1) Secti on 35.115(a) provi des exempti ons from Subparts B <br />through R of the LBP Regs including without I i mi tation, (a) short term emergency assistance <br />I asci ng I ess than 100 days cumul ati vel y is exempted from compi i ance wi th Subpart K as to such <br />short term rental assi stance uni % and (b) exempti on for zero -bedroom uni % i nd udi ng SRO <br />units, for whi ch occupancy by a red pi ent of SU BRECI PI ENT' S cervi ces i s for less than 100 <br />days, and (c) exemption for residential housing units constructed after January 1, 1978. <br />(i i) To the extent that the assi stance provi ded by SU BRECI PI ENT <br />to persons or househol ds meets one or more of the exempti ons set forth i n the L BP Regs, then <br />compl i ance with the noti fi cati on, eval uati on, reducti on, clearance and other requi rements of the <br />L BP Regs i s not requi red rel aced to the subj ect housi ng unit due to such exempti on. <br />(i i i) SUBRECI PI ENT shat I comply with the appl i cabl a provi si erns <br />of both Subpart K and Subpart M (Tenant Based Rental Assistance) of the LBP Regs as to al I <br />tenant -based I Ong term housi ng assi stance, i .e., assi stance to personsthouseholds resi di ng i n <br />housing units cumul ati vel y for more than 100 days. If SUBRECI PI ENT has knowledge that an <br />assisted family or household wi I I occupy a dwel I i ng unit for more than 100 days, the LBP Regs <br />5 <br />
