Use of Funds, SUBRECIR ENT agrees to use al I federal funds provided by CITY to <br />SUBRECIPI ENT pursuant to this Agreement to operate said program, as set forth in "Exhibit B", <br />attached hereto and by this reference incorporated here n. SUBRECI R ENT'S failure to perform as <br />required may, in addition to other remedies set forth in this Agreeme t, result in readjustment of the <br />amount of funds CITY is otherwise obligated to pay to SUBRECI RENT under Paragraph 11 hereof. <br />D. Allowable Costs SUBRECI PI ENT agrees to complete said program on or before <br />June 30, 2009 and to use sai d funds to pay for necessary and reasonabl a costs ai I owabl a under the <br />federal I aw and regul ati ons to operate said program. Licensing. SUBRECI PI ENT agrees to obtain and maintain all required licenses, <br />registrations, accreditation and i nspecti ons from all agencies governing its operab ons. <br />SU BRECI R ENT shall ensure that its staff shall also obtain and maintain all required I i oenses, <br />regi strations, accreditation and i nspecti ons from all agencies governing SUBRECI PI ENTs <br />opera6 ons hereunder. Such I i censi ng requi re menu i nd ude obtai ni ng a City busi ness I ioense, as <br />appl i cable <br />F. Zoning. SUBRECI R ENT agrees that any facility/property used in furtherance of <br />said program shall be specifically zoned and permitted for such use(s) and activity(ies). Should <br />SU BRECI PI ENT fail to have the requi red land entitlement and/or permits, thus vi olating arty local, <br />state or federal rules and regulations relating thereto, SUBRECI PI ENT shall immediately make <br />good -faith efforts to gain compliance with local, state or federal rules and regul ati ons fol I owi ng <br />written notification of said violation(s) from the CITY or other authorized citing agency. <br />SUBRECI PI ENT shall notify CITY immediately of any pending vi olati ons, FaiI ure to notify CITY <br />of pending vi of ati ons, or to remedy such known vi olati on(s) shall result in termination of grant <br />funding hereuncler. SU BRECI PI ENT must make ail corrections required to bring the <br />faci I i ty/property into compl i anee with the law within sixty (60) clays of notification of the <br />vi d ad on(s); fai I ure to gai n oompi iance with n such ti me shat I result i n term nation of grant fundi ng <br />hereunder. <br />G. Separation of Accounts All funds received by SUBRECIRENT from CITY <br />pursuant to this Agreement shall be maintained in an account in a federally insured banking or <br />savi ngs and I can i nsti tub on with record keepi ng of such accouft rr6 ntai ned pursuant to 44 i cable <br />OMB Circular A-110 requirements SUBRECI PI ENT is not required to maintain separate <br />depository accounts for CDBG FUNDS, provided however, the SUBRECI PI ENT must be able to <br />8 <br />
