V1. CONDITIONS ON PROVISIONS OF DEVELOPMENT AND IMPLEMENTING HOMELESS PREVENTION ACTIVITIES I n addi ti on to, and not i n substi tuti on for, other provi si ons of thi s Agreement regardi ng said program using federal funds, SU B RECI PI ENT: A. Represents that i t i s, or may be deemed to be, a H omel ess Preventi on Program [ 24 CFR 576.21(a) (4)] and wi I I i mpl ement home) ess preventi on acti vi ti es subj ect to the I i mi tati ons in 42 USC 11374(a)(4); B. Agrees that, in connection with said program, if ESG funds are to be used to assist fami I i es that have received eviction notices or notices of termination of uti i ity services, the foi- 1 owi ng condi ti ons wi I I be met: 1. The inability of the fami i y to make the required payments must be the result of a sudden reduction in income; 2. The assistance must be necessary to avoid eviction of the family or termination of services to the fami Iy; 3. There must be a reasonable prospect that the family will be able to resume pay- ments wi thi n a reasonabl a peri od of ti rm and 4. The assistance must not supplant funding for preexisting homeless prevention ac - ti vi ties from any other source. VII. PROHIBITION OF NEPOTISM SU BRECI PI ENT agrees not to hire or permit the hiring of any person to fill a position funded through thi s Agreement i f a member of that person's i mmedi ate farm I y i s empl oyed i n an admi ni strati ve capaci ty by SU BRECI R ENT. For the purposes of thi s secti on, the term "i mme- di ate family" means spouse, child, mother, father, brother, sister, brother-in-law, sister-in-law, father-in-law, mother-in-law, son-in-law, daughter -i n -I aw, aunt, uncle~ niece, nephew, stepparent and stepchi Id. The term "admi ni strati ve capaci ty" means havi ng sel ecti on, hi ri ng, supervi sor or management responsi bi I i ti es. 18
