SUBRECI PI ENT is not the subject of any current or threat- <br />ened bankruptcy proceeding. <br />(f) No Pending Legal Proceedings. SUBRECIPIENT isnot the subject of acur- <br />rent or threatened I i ti gati on that woul d or may mated al I y affect SU BRECI PI ENT' S performance <br />under this Agreement. <br />(g) Application Veracity. All provisionsof and information provided in <br />SUB RECI PI ENT' S application for funding submitted to CITY including any exhibits are true <br />and correct in al I mated ail respects. <br />(h) No Pending Investigation. SUBRECIPIENT isnot aware that it is the <br />subj ect of any current or threatened cri mi nal or ci vi I acti on i nvesti gati on by any publ i c agency, <br />i nd udi ng wi thout I i mi tati on a poll i ce agency or prosecuti ng authori ty, that woul d rel ate to affect <br />performance of the Agreement or provision of services hereunder. <br />(4) Compliancewith Subpart K of LBP Reqs Subpart K —Acquisition, Leas - <br />i ng, Support Services, or Operation <br />(a) SUBRECIPIENT acknowl edges and agrees that it shall comply with and im- <br />pl ement the requi rements set forth i n Ti tl e X and the L BP Regs to el i mi nate, as far as practi ca- <br />bl e, L BP hazards i n al I resi denti al property that i s under i is ownershi p, possessi on, or control <br />and/or resi denti ail property occupi ed by persons or fami I i es that recei ve fi nand al or other asci s- <br />tance from SUBRECI PI ENT. <br />(b) SU B RECI R ENT shall l provi de a noti ce to al l resi dentstoc upants of resi den - <br />ti al property that i s under its ownershi p, possessi on, or control and/or resi denti ail property occu- <br />pi ed by persons or fami I i es that recei ve f nanci ail or other assi stance from SU BRECI PI ENT i n <br />accordance wi th Secti on 35.125 of the L B P Regs. <br />(i) SUB RECI PI ENT acknowledges that in connection therewith a <br />visual assessment i s not considered an evaluation for purposes of the LBP <br />Regs. <br />(c) Notification (24 CFR 35.130).
