The current form and versi on of such noti ce i s attached as <br />Attachment No. 2 to this Agreement. <br />(i i i) SU BRECI PI ENT shat I ensure that a1 I occupants, owners, and <br />purchasers of hour ng be noti fi ed i n wri ti ng of the resul is of the presumpti on of <br />L BP and/or L BP hazards, and results of any I ead hazard eval uati on, and any I ead <br />hazard reduction work i n accordance with 24 CFR 35, Subpart A. The current <br />form and versi on of such noti ce i s attached as Attachment N o. 3 to thi s Agree- <br />ment. <br />(d) Lead Hazard Evaluation (24 CFR 35.125). SUBRECIPIENT shall conduct <br />ail I activities described in Section 35.1015 relating to visual assessment, paint stabilization, risk <br />assesshnent, and mai ntenance wi th regard to all residential property that is under its ownership, <br />possess on, or control and/or resi denti al property occupi ed by persons or favi I i es that recei ve <br />fi nand al or other assi stance from SU B RECI PI ENT, except for the exempti ons descri bed bel ow <br />in section 4 (d)(i)(1). <br />(i) SUBRECI R ENT shal I cause a visual assessment to identify <br />deteri orated pai nt i n al I resi denti al property that i s under its ownershi p, possessi on, or control <br />and/or resi denti al property oc cupi ed by persons or fami I i es that recei ve fi nand al or other assi s- <br />tance from SUBRECI PI ENT. <br />(1)Secti on 35.115(a) provi des exempti ons from Subparts B <br />through R of the L BP Regs, i nd udi ng wi thout I i mi tati on, (a) short term emergency ass stance <br />I asti ng I ess than 100 days cumul ati vely i s exempted from comps i anoe wi th Subpart K as to such <br />short term rental assi stance uni ts, and (b) exempti on for zero -bedroom uni % i nd udi ng SRO <br />uni % for whi ch occupancy by a reci pi ent of SU B RECI PI ENT' S servi ces i s for I ess than 100 <br />days, and (c) exemption for resi denti al housi ng units constructed after January 1, 1978. <br />(i i) To the extent that the assi stance provi ded by SU BRECI PI ENT <br />to persons or households meets one or more of the exempti ons set forth i n the L BP Regs, then <br />comps i ante wi th the noti fi cati on, eval uati on, reducti on, d earance and other requi rements of the <br />L BP Regs i s not requi red rel ated to the subj ect housi ng uni t due to such exempti on. <br />(i i i) SU BRECI PI ENT shal I comp) y wi th the apps i cabl a provi si ons <br />of both Subpart K and Subpart M (Tenant Based Rental Assistance) of the LBP Regs. as to all <br />tenant -based I ong term housi ng assi stance, i.e., assn stance to personsthousehol ds resi di ng i n <br />housing units cumulatively for more than 100 days. If SU BRECI PI ENT has knowledge that an <br />assisted favi I y or household will occupy a dwel I i ng unit for more than 100 days, the LBP Regs <br />
