PROGRESS REPORTS AND STATEMENT OF COSTS <br /> <br />The Grantee shaJlsubmit QuarterlY progress reports, January 15, April 15, July 15 and October <br />15, on the stalus of the Projact to the Department of Water Resources. The submittal and approval <br />by the State of these reports is a requirement for continued disbursement of State Gtant funds. <br />Progress reports shall summarfza the work completed during the reporting period, include a <br />statement of progress toward complelfon compared to tile Project schedule, and provide a <br />comparfson of com 10 date compared to lhe approved scope of work and Project budget <br /> <br />SECTION 9 FINAL REPORTS <br /> <br />Within 60 days of Project complelfon or tenn/natlon. the Grantee shall submit a final report on <br />Project completfon or tenn/natlon and expenditures for the Slate's review and comment The report <br />shall be modified to incorporate the Stale's comments, if any, and resubmitted within sixty (60) days <br />of the Grantee's receipt of the Stale's comments. <br /> <br />SECTION 10 OPERA TrONS AND MAINTENANCE OF 'CONSTRUCT/ON" PROJECT <br /> <br />In consIderation of the State Grant, the Grantee agrees, for the useful fife of the Profect to <br />expedllfously commence and 10 conlfnue opera lion of the Project and shall cause the Projectto be <br />operated in an efficient and economical manner; shall provIde for all repairs._ renewals, and <br />replacements necessary to the efficient operalfon of the Project; and shall cause the Project to be <br />maintained /n es good and efficient condllfon as upon ilS constructiOn, ordinary and reasonable wear <br />and depreciallon excepted, Refusal of the Granlee to operate and maintain the Project in <br />accordance With this provIsion may, at the opllon of the State, b& considered a material breach of <br />contract and may be treated as default under default provl8lons exhibit A-25. <br /> <br />SECTION 11 RE!.A TlONSHIPS OF PARTIES <br /> <br />The Grantee. ils contractors, subcontractors, and lIlerr respective agenls and employees nsqulred <br />for performing any work under thIs Agreement shall act In an Independent capacity and not as <br />officers, employees. or agenls of the State. <br /> <br />The Grantee Is sole~ reaponsible for plannIng and Implementation of the Projec:t. Review or <br />approval of plans, spech'lcalforis, -bIc/ doctlments or other constructfon doouments:~ the State Is <br />solely for the purpose of proper admInistration of State Grant funds and shall not b& deemed to <br />reI/eve or reslrfot the Grantee's responsibility, <br /> <br />SECTTON 12 PERMITS, LICENseS, APPROVALS AND LEGAL OBLIGATIONS <br /> <br />The Grantee shall be responsIble fcrobta/ning any and all permIts, licenses and approvals required <br />For perfonning any work under this Agrsement, Indudlng Ihosa necessary for pfanning and <br />fmplamenlfng the Project The Grantee shall be responsible for complylng With all applicable <br />federal, S tete and local laws, rures or regulations affecting any such work, specifically including, but <br />not limited to, envIronmental, labor, procurement and safetyfaws, rules, regulations and ordInances. <br /> <br />SECTION 13 GRANTeE'S RESPONSIBILITlES FOR WORK <br /> <br />The Grantee shall be responsible for work and for parsons cr entltfes engaged in Work, includIng, <br />but nolllmitad to, subcontractors. supplIers and providers of services.
