<br />Amendment Application No. 2008-06 <br />Conditional Use Permit No. 2008-05 <br />Variance No. 2008-04 <br />Site Plan Review No. 2008-02 <br />August 25, 2008 <br />Page 5 <br /> <br />location or surroundings, the strict application of the zoning ordinance <br />is found to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this chapter" <br />[SAMC Section 41-638 (2) (i)] . Pursuant to this section, Templo Calvario <br />has requested a variance from the City's off-street parking standard as it <br />relates to churches, chapels and religious meeting halls (SAMC Section 41- <br />1411) . This section requires a minimum of one parking space for each <br />three fixed seats, plus one space for each 35 square feet of floor area in <br />seating areas without fixed seats. Ancillary use areas, such as offices <br />and classrooms, are not parked separately as it is expected that they <br />would be occupied at off-peak times from the main assembly area or, during <br />worship services, would be in use by those who had also arrived for the <br />main service. Thus, the size of the assembly area drives the parking <br />requirement. <br /> <br />The limiting factor for the site is the amount of surface parking that <br />can be achieved within the improved complex. Although there are off-site <br />parking opportunities in the adjacent industrial complex to the south and <br />on-street parking available in the area, the site does not meet the <br />on-site parking requirement for a church. While the project applicant <br />has considered subterranean and structured parking, they have <br />determined that it is not feasible at this time due to the cost involved <br />and the need to acquire additional land and buildings. The church has <br />indicated that the overall site will function in a shared use manner. The <br />operational plan of the church limits use of the meeting rooms and <br />fellowship hall to when the church is not providing worship services as <br />the church is the largest parking generator. <br /> <br />Today, Templo Calvario's 13,392 square foot facility has a parking <br />requirement of 383 spaces and is a legal non-conforming use at 303 <br />spaces. The proposed assembly area will be on the first floor only and <br />will contain 22,491 square feet of non-fixed seat floor area, which <br />calculates to a parking requirement of 643 spaces. The parcels occupied <br />by Templo Calvario and other buildings in the complex contain 303 <br />parking spaces, of which 291 are available for shared use (12 to be <br />reserved for use by tenants). The new sanctuary will require an <br />additional 260 spaces, resulting in 352 fewer on-site spaces than is <br />required by code. <br /> <br />75C-7 <br />
