Variance No. 2008-21 <br />Modification to CUP No. 1964-172 <br />January 12, 2009 <br />Page 4 <br />Additional landscaping will be added to the site including three Sweet <br />Shade trees and 38 Indian Hawthorn `Clara' shrubs. Additional trees will <br />be planted near the new building including Ginkgo Biloba and Pink Snow <br />Showers Flowering Cherry Trees. <br />In summary, the existing child care facility is proposing to amend the <br />existing conditional use permit to allow an additional facility to the <br />site. The new multi-purpose building is located at the rear of the <br />subject site and the building is a minimum of 70 feet from the nearest <br />adjoining residential properties. In addition, the structure will be used <br />as a lunch room and to hold special events and no additional student <br />enrollment is proposed with this project. The existing child care <br />facility was constructed with the drive aisle and unloading and loading <br />zone in front of the structures. The applicant is proposing to modify the <br />existing drive aisle configuration in order to provide 10 feet of <br />landscaping. In addition, the project site currently provides a 38-foot <br />section of front yard landscaping along a portion of the existing site. <br />The applicant is proposing landscaping material to comply with the <br />landscape standards and provides large amounts of existing landscaping <br />that exceed the code requirement. The existing child care facility <br />provides a valuable service to the City and surrounding residents and <br />complies with the intent of Policy 4.3 of the Land Use Element. Lastly, <br />Policy 5.1 of the Land Use Element encourages developments that have a net <br />community benefit. Therefore, staff recommends that the Planning <br />Commission approve Variance No. 2008-21 and modification to Conditional <br />Use Permit No. 1964-172 as conditioned. <br />CEQA Compliance <br />In accordance with the California Environmental Quality Act, the <br />recommended action is exempt from further review per Section 15305. This <br />Class 5 exemption allows minor alterations in land use which do not result <br />in any changes in land use or density.
