<br />D. The Parks, Recreation and Community Services Agency has <br />recommended that the Council increase the admission fees to the Santa <br />Ana Zoo at Prentice Park by one dollar ($1.00). This modest increase will <br />be used to help offset the costs of operating the Zoo. Recent new <br />improvements, including the endangered species carousel, have added <br />value and will significantly enhance the experience for Zoo visitors, and <br />this modification will prepare the Zoo for the upcoming Tierra De Las <br />Pampas exhibit and three additional small monkey exhibits. <br /> <br />E. The City charges individuals who violate State and local parking laws with <br />fines. Effective January 1, 2009, California Senate Bill 1407 amended <br />state law to require the City to transfer to the State three dollars ($3.00) <br />per each parking fine it collects. Currently, the City does not charge the <br />individual who has violated parking laws with State required fees. The <br />$3.00 fee is used to pay for new state courthouses. Therefore, it is <br />necessary for the City of Santa Ana to also incorporate this increase into <br />all parking violation fees <br /> <br />F. Based upon the testimony, reports and other evidence submitted on this <br />matter, this city council makes the above-specified findings. <br /> <br />Section 2: The modified charges, fees, and service charges set forth in Exhibit <br />1 to this Resolution, which is incorporated herein by this reference, are hereby adopted. <br />Each charge, fee or service charge set forth shall be levied until further resolution of this <br />Council. <br /> <br />Section 3: To the extent that any fee or service charge established pursuant to <br />City Resolution No. 2008-041 is inconsistent with the fees or service charges <br />established pursuant to this Resolution, then said Resolution No. 2008-041 is hereby <br />repealed. <br /> <br />Section 4: That without further action of the City Council said charges, fees <br />and service charges shall be incorporated into the City's Miscellaneous Fee Schedule. <br /> <br />Section 5: If any charge, fee, service charge, section, subsection, sentence, <br />clause, phrase or word of this Resolution is for any reason held to be invalid by a court <br />of competent jurisdiction, such decision shall not affect the validity of the remaining <br />portions of this Resolution. The City Council hereby declares that it would have passed <br />and adopted this .r:~esolution, and each and all provisions hereof, irrespective of the fact <br />that one or more provisions may be declared invalid. <br /> <br />Section 6: That except as otherwise may be required by state law, this <br />Resolution shall take effect immediately upon its adoption by the City Council, and the <br />Clerk of the Council shall attest to and certify the vote adopting this Resolution. <br /> <br />Resolution No. 2009-009 <br />Page 2 of 8 <br />
