"Scope of Work" CITY SERVICES A. CITY agrees to and does hereby grant to CONCESSIONAIRE an exclusive concession to sell and vend food and beverage items on the premises of the Santa Ana Zoo on the terms and conditions provided in CONCESSIONAIRE's proposal dated June 9, 2000, copies of which are on file in the office of the CITY's Clerk of the Council, which said proposal is incorporated herein by this reference. B. CITY shall furnish, at its own expense, power, water, hot water heater, sewer services, trash receptacles and trash disposal for permanent stands. C. CITY shall be responsible for routine repairs and upkeep to the outside of the building. D. CITY shall allow CONCESSIONAIRE to advertise its name as vendor of merchandise in the vending area, subject to prior approval of the Executive Director of the Parks, Recreation and Community Services and in conformance with CITY's Municipal Code. CONCESSIONAIRE SERVICES o sell, vend or rent items as described in A. CONCESSIONAIRE agrees t CONCESSIONAIRE's proposal, or as mutually agreed between CITY and CONCESSIONAIRE. C. CONCESSIONAIRE agrees to provide zoo employees with proper identification a discounted rate of ten cents ($.10) for coffee and soft drinks, all other food and beverage will be sold to them at the regular rate. D. CONCESSIONAIRE agrees not to sell or vend merchandise at any event CITY's Executive Director of Parks, Recreation and Community Services gives a thirty (30) day written notice to CONCESSIONAIRE that CONCESSIONAIRE shall not sell or vend at such event. A determination made by the CITY's Executive Director of the Parks, Recreation and Community Services that CONCESSIONAIRE shall not sell or vend at a particular event shall be final unless an appeal is made to the City Manager of CITY within three (3) days from and after the date of said notice. In the event of an appeal, the City Manager's determination shall be final. E. CONCESSIONAIRE agrees not to sell gum, shelled peanuts, or food wrapped in plastic. Additionally, CONCESSIONAIRE agrees not to supply straws or plastic lids or use styrofoam products, and that all times paper cups must be used. F. CONCESSIONAIRE agrees to provide adequate freezer and cooler storage for food concession items. G. CONCESSIONAIRE agrees to remove food -related trash from concession stand to portable packer bins at east end of zoo property. H. CONCESSIONAIRE agrees that delivery of food and supplies to the stand and trash removal shall be conducted when the zoo is closed to minimize interference with zoo visitors. I. CONCESSIONAIRE agrees to be responsible for all repairs to interior of building caused by CONCESSIONAIRE's use or negligence, subject to CITY approval. The cost of such repairs shall be the responsibility of CONCESSIONAIRE. J. CONCESSIONAIRE agrees to be responsible for keeping the concession building and associated eating area clean on a daily basis including, washing windows, hosing walkways, and removal of associated trash and litter in the concession area. K. CONCESSIONAIRE agrees to provide capital improvements to the area adjacent to the concession including, but not limited to adding a third service window, modifying the
