County Of Orange Proposition 42 - <br />City Aid Program Agreement <br />February 4, 2008 <br />Page 2 <br />The attached agreement requires the City to commit to the following: <br />1. Maintain the existing "Maintenance of Effort" for the use of local <br />funds for street and highway, maintenance, rehabilitation, <br />reconstruction, and storm damage repair; <br />2. Expend the CAP allocations by June 30, 2011 on Prop. 42 eligible <br />projects or return the CAP allocations to County; and <br />3. Provide the County with FY 09/10 CAP expenditure certification by <br />August 31, 2011. <br />The County will distribute CAP allocations to the City upon receiving <br />Prop.42 funding from the State and approval of the attached CAP agreement <br />by the Board of Supervisors. Distribution of CAP allocations will be <br />made to the City on a first come first served basis, with the submittal <br />of proof of project award documentation and city invoices. <br />Implementation of the CAP is dependent on the County receiving its <br />funding from the State's Prop. 42 grant program. The County is <br />tentatively scheduled to approve the CAP agreements on June 2, 2009. <br />ENVIRONM]3NTAL IMPACT <br />There is no environmental impact associated with this action. <br />FISCAL IMPACT <br />Funds will be received in the City's Traffic Congestion Relief Fund <br />(account no. 28-01-5361). <br />//~ <br />James G.
