Santa Ana held a duly noticed public hearing and at that time considered all <br />testimony, written and oral. <br />D. Conditional Use Permit No. 2009-08 has been filed with the City of Santa <br />Ana seeking to allow the construction of a hotel at 6 East MacArthur Place. <br />Pursuant to SD-76, hotel uses are permitted subject to the issuance <br />of a Conditional Use Permit. <br />2. Santa Ana Municipal Code Section 41-638 authorizes the City <br />Council to grant a conditional use permit upon making certain <br />findings. <br />i. Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />community? <br />The proposed use will provide an additional service to <br />the community by providing ahigh-quality business hotel <br />that will offer a variety of amenities including 3,000 <br />square feet of conference room/meeting space, media <br />area, lounge, cafe, pool and spa to it guests. Conditions <br />of approval have been included to ensure the quality <br />and the attractiveness of the overall design which will <br />contribute to the general well being of the community. <br />Will the proposed use under the circumstances of the particular <br />case be detrimental to the health, safety, or general welfare of <br />persons residing or working in the vicinity? <br />The proposed hotel use in conjunction with the rest of <br />the MacArthur Place South development will not be <br />detrimental to persons residing and working in the area. <br />Any effect relating to the health, safety and general <br />welfare of persons residing or working in the vicinity <br />have been addressed through various mitigation <br />measures identified in the Addendum to Environmental <br />Impact Report 2004-02. These mitigation measures <br />cover all aspects of the hotel from construction to daily <br />operation and include mitigation measures relating to <br />construction noise and soil retention to the permitted <br />hours of operation for material deliveries and pick-ups. <br />iii. Will the proposed use adversely affect the present economic <br />stability or future economic development of properties <br />surrounding the area? <br />Resolution No. 2009-025 <br />Page 2 of 95 <br />
