e) For a project located within an airport land use plan or, where such a plan has not been adopted, <br />within two miles of a public airport or public use airport, would the project result in a safety hazard <br />for people residing or working in the project area? (No Substantial Change from Previous Analysis) <br />The nearest public use airport, John Wayne Airport, is approximately 1.1 miles from the site. The FAA <br />previously issued two Determinations of No Hazard for two different locations of the Cinema Tower. <br />As described in the Introduction, Section C, both Determinations have expired. The proposed <br />relocation of the Cinema Tower will require a new aeronautical study by the FAA at a future time <br />when the Cinema Tower is scheduled for construction. <br />Mitigation Measure H-1 -Prior to the issuance of a building permit, the project developer shall <br />provide evidence to the Planning Manager that an FAA Determination of No Hazard to Air <br />Navigation has been obtained for the relocated Cinema Tower. The project developer shall <br />demonstrate compliance with any conditions imposed by the FAA in their Determination. <br />Implementation of the above mitigation measure will ensure that no new or more severe impacts <br />beyond those addressed and mitigated in the EIR will occur. Therefore, the EIR remains complete and <br />adequate as it relates to hazards. <br />~ For a project within the vicinity of a private airstrip, would the project result in a safety hazard for <br />people residing or working in the project area? (No Substantial Change from Previous Analysis) <br />The project is not located within the vicinity of a private airstrip and, therefore, would not expose <br />people residing or working in the project area to a safety hazard. <br />~ Impair implementation of or physically interfere with an adopted emergency response plan or <br />emergency evacuation plan? (No Substantial Change from Previous Analysis) <br />The construction of the proposed project will not produce any physical constraints or impair an <br />adopted emergency response plan or an emergency evacuation plan. Standard conditions have been <br />imposed regarding provision of fire access roads and fire lane markings as well as project review by <br />the Fire Authority. As analyzed in the EIR, there will be no impact related to impairment of emergency <br />response plans or emergency evacuation plans. <br />h) Expose people or structures to a significant risk of loss, injury or death involving wildland fires, <br />including where wildlands are adjacent to urbanized areas or where residences are intermixed with <br />wildlands? (No Substantial Change from Previous Analysis) <br />The EIR identified potential impacts in the area of hazards and hazardous materials that would result <br />from project implementation. No changes have occurred in this area from the analysis provided in the <br />EIR. Therefore, the EIR remains adequate and complete for this topic. <br />V. Hydrology and Water Quality <br />Hydrology and water quality impacts due to short-term construction activities and long-term operation were <br />identified in the EIR. Mitigation measures were included to reduce potential impacts to less than significant. <br />Mitigation measures from the EIR are incorporated herein by reference and include HW-1 thru HW-11, <br />which, per the EIR, reduced project impacts to a less than significant level.
