Any square footage and supply amounts given by the City in this RFP are only or general <br />information only and the City's is not held accountable for any cost quote based on the provided figures. <br />5.0 CITY HOLIDAYS <br />New Year's Day Independence Day Day after Thanksgiving <br />Martin Luther King Day Labor Day Christmas Eve <br />President's Day Veteran's Day Christmas Day <br />Memorial Day Thanksgiving Day <br />Holidays falling on weekend days may effect the observance day for the Holiday. The Property & Facilities <br />Manager shall supply actual dates of City Holidays to the Contractor at the start of each calendar year. <br />6.0 SUPERVISION AND SAFETY <br />The Contractor shall be responsible for the supervision and direction of the work performed by his /her <br />employees and shall at all times provide a full -time manager or crew leader on the premises to carry out the <br />responsibility. The manager or crew leader shall the authority to act as agent for the Vendor in his/her <br />absence and shall be fully qualified to implement the contract specifications. <br />The Contractor shall be responsible for instructing his/her employees in all safety measures. All equipment <br />used by the Contractor shall be maintained in safe operating condition at all times and free from defects or <br />wear which may constitute a hazard to any person(s). All employees will wear proper personal protective <br />equipment while working on City premises. Contractor's supervisors shall be literate and conversant in the <br />English language with management personnel. Contractor's supervisors shall also be capable of <br />communicating fully with all employees in the event they do not speak English. <br />The Contractor shall comply with and ensure that the Contractor's personnel and subcontracted personnel <br />comply with all current applicable local, state, and federal policies, regulation, and standards relating to <br />safety and health. The Contractor shall provide or cause to be provided all technical expertise, qualified <br />personnel, equipment, tools and material to safely accomplish the work specified to be performed by the <br />Contractor. <br />The Contractor shall provide all necessary barricades, signs to indicate safety conditions, detours and <br />yellow safety caution tape as necessary to provide a safe environment. <br />The City may require the removal of any of the contractor's employees who are found to be incompetent, <br />careless or insubordinate; or appears to be alcohol or drug impaired or poses a safety risk. <br />The Contractor shall provide an emergency telephone number where he /she can be reached during normal <br />operating hours and after normal operating hours. <br />7.0 REMEDY FOR FAILURE TO PERFORM REQUIRED SERVICE <br />The contractor may be called back to correct deficiencies in adherence to the general specifications at no <br />additional charge to the City. Response time should be as soon as possible but no more than two (2) hours <br />from the receipt of the call during normal business days. <br />Hours not worked will be deducted from monthly payments if these hours are persistent or if a quality <br />problem appear. Deduction for hours not worked does not constitute a waiver of the specifications or <br />acceptance of the conditions performance. Contractor's failure to perform under the term and frequencies <br />specified herein, may result in a reduction in the monthly payment due the contractor or termination of the <br />contract. The types of reductions described below may, at the City's option, be imposed after notification to <br />the Contractor of any deficiencies and failures to provide remedies. <br />
