<br />Agreement #W7 -GJC-10 <br />City of Santa Ana <br /> <br />1 <br /> <br />(2) 20 C.F.R. Part 667; and <br /> <br />2 <br /> <br />(3) State implementing legislation. <br /> <br />3 23. PROGRAM INCOME <br /> <br />4 COUNTY's maximum obligation hereunder shall be reduced by the amount of any program income <br /> <br />5 earned by CONTRACTOR, from sources other than COUNTY, as a result of this Agreement or the <br /> <br />6 services provided by CONTRACTOR pursuant to this Agreement. It shall be the responsibility of <br /> <br />7 CONTRACTOR to inform the COUNTY in writing of any income earned as a result of this Agreement. <br /> <br />8 It is mutually understood that the State or Federal agency responsible for providing the funding for <br /> <br />9 this Agreement may designate certain revenue of CONTRACTOR as Program Income. To be designated <br /> <br />10 as Program Income and, therefore, as other than a cost off-set, CONTRACTOR shall do all of the <br /> <br />11 following: <br /> <br />12 (a) Submit a plan to the CONTRACT ADMINISTRATOR for use of any and all proposed Program <br /> <br />13 Income; <br /> <br />14 (b) Set-up and maintain a separate bank account for any proposed Program Income and account <br /> <br />15 for any and all such income received; and <br /> <br />16 (c) Report to CONTRACT ADMINISTRATOR any and all Program Income received no later than <br /> <br />17 thirty (30) days from the date of receipt; record the amount received on internal financial records; and <br /> <br />18 indicate the amount received on the monthly claim submitted to CONTRACT ADMINISTRATOR. <br /> <br />19 CONTRACT ADMINISTRATOR shall then forward the plan for the requested use of the proposed <br /> <br />20 Program Income to the appropriate State and/or Federal agencies for approval. <br /> <br />21 CONTRACTOR shall not spend any of the proposed Program Income unless or until such time as <br /> <br />22 CONTRACT ADMINISTRATOR obtains authorization for the use of the Program Income from the <br /> <br />23 responsible State and/or Federal agency and provides CONTRACTOR with prior written approval for the <br /> <br />24 use of the funds. <br /> <br />25 <br /> <br />26 <br /> <br />WIA Cost Reimbursement Agreement - Green Jobs Corps <br /> <br />16 <br />
