Saviano Company, Inc. Mountain View $133,605 <br /> 2. Y&M Construction, Inc. Gardena $138,910 <br /> Westlake $182,350 <br /> 3. Malibu Pacific Tennis Courts, Inc. Village <br /> 4. Court Concepts, Inc. Santee <br /> $251,513 <br /> Four bids were received and all were responsive. The lowest bid was <br /> submitted by Saviano Company, Inc. for $133,605 which is below the <br /> Engineer's estimate of $292,350. <br /> After the bid opening, Malibu Pacific Tennis Courts, Inc. sent a letter <br /> protesting Saviano's bid. They stated that Saviano's bid was not <br /> responsive because Addendum No. 2 had been submitted by fax and not in a <br /> sealed envelope as required by the bidding instructions. After reviewing <br /> all relevant documents and upon consultation with the City Attorney's <br /> Office, Public Works has determined that Saviano's original bid was <br /> submitted in a sealed envelope and that faxing addendum No. 2 to the <br /> City was a minor irregularity. Further, it did not change the amount of <br /> the bid nor did it give Saviano an advantage or benefit not allowed <br /> other bidders. Accordingly, Public Works staff recommends the contract <br /> be awarded to Saviano. <br /> ENVIRONMENTAL IMPACT <br /> In accordance with the California Environmental Quality Act, the <br /> recommended action is exempt from further review. Categorical Exemption <br /> ER No. 2009-165 was filed for this project. <br /> FISCAL IMPACT <br /> The funding analysis shows a total estimated construction cost of <br /> $170,000 for the project (Exhibit 2).
