Set Public Hearing For <br /> CONTINUED TO <br /> ?~?-`-`~'2 - FILE NUMBER <br /> CITY MANAGER <br /> RECOMMENDED ACTION <br /> Receive and file the staff report approving modifications to Variance No. <br /> 2004-09. <br /> PLANNING COMMISSION ACTION <br /> On December 14, 2009, the Planning Commission adopted a resolution <br /> approving modifications to Variance No. 2004-09 allowing a cover charge, <br /> serving draft beer, allowing bottle service, advertising or signs <br /> indicating the availability of alcohol, expansion into the basement level <br /> and allowing the hours of operation from 11:00 a.m. to 2:00 a.m. as <br /> conditioned; and adopted a resolution approving modifications to Variance <br /> No. 2004-09 pertaining to dancing, and use of the rear door by a vote of <br /> 6:0 for the Proof Bar located at 215 North Broadway. The Planning <br /> Commission made no changes to the recommended conditions of approval <br /> outlined in the attached staff report (Exhibit A) with the exception of <br /> Condition No. 24, use of the rear door only for emergencies and <br /> deliveries, which was deleted. <br /> FISCAL IMPACT <br /> There is no fiscal impact associated with this action. <br /> J M.
