lids and interior waste receptacles when missing. Lids and interior <br /> waste receptacles shall be provided by the City. <br /> (2) All cigarette urns shall be siRed daily Monday through Friday. The <br /> sand in the cigarette urns shall be fresh and leveled. Contractor shall <br /> replace cigarette urn sand with #20 white silica sand once per month. <br /> 17. City Inspection <br /> a) The Director or his designated representative shall regularly inspect the <br /> parks, playgrounds, fields and all other City property subject to this Agreement. <br /> If said inspection results in discovery of work that is not performed in the <br /> manner, and to the professional degree set forth in the Specifications, Contractor <br /> agrees that the City shall deduct fiom Contractor's next monthly payment, the <br /> City's actual or estimated cost of performing the work to bring the property into <br /> conformance with the specifications. Additionally, City shall impose liquidated <br /> damages of up to $300.00 pea• inspection, per park not meeting the specifications <br /> during any such inspection. <br /> III. EXTRA WORK <br /> It is the City's intent to keep parks and other public recreational sites in a beautifiil and exceptionally <br /> well maintained condition. It is also the City's intend to continuously improve parks and public <br /> recreational sites until they are the best in the county. It is with these intents in mind that the Director <br /> <br /> may consider authorizing extra work. <br /> A. Damage or malfunction to plant material or irrigation system equipment (from valve to <br /> water meter), with the exception of irrigation heads and lateral lines, by any of the <br /> following may be considered outside the scope of this Agreement: <br /> {1) Acts of God <br /> (2) Civil Disorder <br /> (3) Vehicle Collision (excluding Conhactor and its employees and subs) <br /> (4) Excavation or re-surfacing of the street <br /> (5) Power failures <br /> (6} Underground wiring damage <br /> Contractor will not be considered responsible for replacement. Contractor must demonstrate to <br /> the satisfaction of Director that one of the above occurred in order to be excused from <br /> performing under the Agreement. <br /> B. Requests for Extra Work -The Director may request that the Contractor submit proposals <br /> for extra work in order to improve the grounds-landscape in the contract sites. The Contractor <br /> shall submit proposals using the City's Proposal for Extra Work Spreadsheet (see Attachment <br /> 7). The Contractor shall complete the spreadsheet in its entirety using hislher proposed extra <br /> work pricing (that is a part of this agreement) in order for the proposal to be considered. City <br /> reserves the right to requests materials/equipment receipts with invoices. All labor shall be <br /> quoted on a "not to exceed" basis and City will only pay for labor actually incurred. <br /> 25C-109 <br /> <br />
