SUCCESSORS IN INTEREST (y.8yr1) <br />Unless otherwise provided in this ease, the terms, covenants, <br />and conditions contained herein sizail apply to and bind the heirs, <br />successors, executors, administrators, and assigns of all the <br />parties hereto, all of whom shall be jointly and severally liable <br />hereunder. <br />38. WAIVER OP RIGHTS (8.1295) <br />The failure of LESSOR or LESSEE to insist upon strict performance <br />of any of the terms, conditions, and covenants in this Lease <br />shall not be deemed a waiver of any right or remedy that LESSOR or <br />LESSEE may have and shall not be deemed a waiver of any right or <br />remedy for a subsequent breach or default -of the terms, conditions, <br />and covenants herein contained. <br />39. LEASE ORGANIZATION (~+.89N) <br />The various headings in this Lease, the numbers thereof, and the <br />organization of the Lease into separate sections and paragraphs <br />are for purposes of convenience only and shall not be considered <br />otherwise. <br />40. PARTIAL INVALIDITY (~.BgN) <br />If any term, covenant, condition, or provision of this Lease is <br />held to be invalid, void, or unenforceable by a court of compe- <br />tent jurisdiction, the remainder of the provisions hereof shall <br />be in no vray affected, impaired, or invalidated thereby and shall <br />remain in full force and effect. <br />41. ANIENDr~7ENTS ( 8.1296 ) <br />This Lease sets forth the entire agreement bet~~reen LESSOR and LESSEE <br />and any modification must be in the form of a written amendment. <br />42. rORCE MAJEURE (4.89N) <br />If either party hereto shall be delayed or prevented from per- <br />forming any ob liation required hereunder by reason of acts of <br />God, laws, ordinances, or other governmental regulations, or <br />other cause beyond the control of the party obligated and for <br />which he has no fault (financial inability excepted), performance <br />of such obligation shall be excused for the period of such delay. <br />The time provided for performance of any such obligation shall <br />be extended to encompass the period of such delay. However, <br />nothing in this clause shall excuse LESSEE from the prompt pay- <br />ment of any rental or other charge required hereunder to be <br />paid by LESSEE except as may be expressly provided herein. <br />4 3 .
