ADULT CROSSING GUARD PROGRAM AGREEMENT <br /> THIS AGREEMENT, made and entered into this day of January, 2010 by and <br /> between ALL CITY MANAGEMENT SERVICES, INC., a Califomia Corporation (hereinafter <br /> "Consultant"}, and the City of Santa Ana, a charter city and municipal corporation organised and <br /> existing under the Constitution and laws of the State of California (hereinafter "City"}. <br /> RECITALS <br /> A. The City desires to retain an entity having special skill and knowledge in the field of <br /> crossing guards. <br /> S. Consultant represents that Consultant is able and willing to provide such services to the <br /> City. <br /> C. In undertaking the performance of this Agreement, Consultant represents that it is <br /> know)cdgeable in its field and that any services performed by Consultant under this <br /> Agreement will be performed in compliance with such standards as may reasonably be <br /> expected from a professional consulting firm in the field. <br /> NOW THEREFORE, in consideration of the rnutual and respectsve promises, and subyect to the <br /> terms and conditions hereinafter set forth, the parties agree as follows: <br /> 1. SCOPE OF SERVICES <br /> Consultant shall agree to perform school crossing guard services for the City of Santa <br /> <br /> Ana. The scope of work shall be as follows: <br /> a. Consultant will monitor, supervise, and assure the safety of all school children that <br /> utilize intersections and crosswalks while moving to and from school. <br /> b. Consultant shall perform all work to the highest professional standard and in a <br /> manner deemed reasonably satisfactory to the Chief of Police or his designee. <br /> c. Consultant will provide an estimated 56,455 hours per year of crossing guard services <br /> by qualified adult crossing guards approved by the City during pre-determined time <br /> periods at specific locations throughout the City as shown in Exhibit "A". The <br /> estimated hours above are calcuiated based on the number of hours per day multiplied <br /> by the number of annual school days. However, Consultant is required to staff the <br /> crossing guards positions when the schools modify their schedules to accommodate <br /> the academic needs of their students. These modifications are represented in the <br /> 56,6! 1 hours of crossing guard services provided in 2008. <br /> 25C-3 <br /> <br />
