Failure of TENANT to properly maintain and repair the <br />Premises shall constitute a breach of the terms of this Lease. <br /> <br />15. INSURANCE (PME5.1.8 N) <br /> <br />TENANT agrees, at its sole expense, to obtain insurance as required below, and to deposit with Director <br />prior to the provision of services under this Lease, Certificates of Insurance, including all endorsements <br />required herein, necessary to satisfY Director that the insurance provisions ofthis Lease have been <br />. complied with, and to keep such insurance and the certificates and endorsements therefor on deposit with <br />Director during the entire term of this Lease. In addition, sub-tenant, or any contractors performing work <br />on behalf of TENANT pursuant to this Lease, shall be covered under TENANT'S insurance or shall <br />obtain insurance subject to the same terms and conditions as set forth herein for TENANT. All insurance <br />policies required by this Lease shall declare any deductible or self-insured retention (SIR) which shall <br />specifically be approved by the County Executive Office/Office of Risk Management. TENANT shall be <br />responsible for reimbursement of any deductible to the insurer. If TENANT is self-insured, TENANT <br />shall provide Director a letter of self-insurance satisfactory to the County Executive Office/Office of Risk <br />Management, verifYing all the stated coverage minimums and comparable terms. In the event the <br />TENANT becomes commercially insured, the policy or policies of commercial insurance maintained by <br />TENANT shall provide the minimum limits and coverage as stated herein. <br /> <br />The policy or policies of insurance must be issued by an insurer licensed to do business in the State of <br />California (California Admitted Carrier). <br /> <br />Minimum insurance company ratings as determined by the most current edition of the Best's Key Rating <br />Guide/Property-CasualtylUnited States or ambest.com shall be "A-" (Secure Best's Rating) and "VIII" <br />(Financial Size Category). <br /> <br />County Executive Office/Office of Risk Management retains the right to approve or reject carrier after a <br />review of the company's performance and financial ratings ifit does not meet the above standards. <br />The policy or policies of insurance maintained by the TENANT shall provide the minimum limits and <br />coverages as set forth herein below: <br /> <br />Coverage <br />Commercial General Liability, to include <br />Broad Form Property Damage Endorsement <br />and Contractual Liability <br /> <br />Minimum Limits <br />$1,000,000 combined single limit <br />per occurrence/$2,000,000 aggregate <br /> <br />Automobile Liability, including all owned <br />'non-owned and hired vehicles <br /> <br />$1,000,000 combined single limit <br />per occurrence <br /> <br />Workers' Compensation <br /> <br />Statutory Requirements <br /> <br />Employer's Liability <br /> <br />$1,000,000 per occurrence <br /> <br />Insurance shall be in force the first day of the term of this Lease. <br /> <br />It' Street Triangle Lease (07.01.09) <br /> <br />5 <br />
