Chapter 12 Responses to Comments Received Since Publication of the Final EIR <br />■ A copy of each unit's certified tier specification, BACT documentation, and California ARB or <br />AQMD operating permit shall be provided at the time of mobili .Zation of each applicable unit of <br />equipment. <br />Response to Comment AQMD -7 <br />The commenter refers the City to a website "for additional measures to reduce off -road construction <br />equipment ..." However, the tables listed on the website depict a breakdown of emission reductions per <br />vehicles and power ratings complying with California ARB Tiers 1, 2, 3, and 4 and do not list specific <br />feasible mitigation measures. Comment noted. <br />Response to Comment AQMD -8 <br />This comment asks the City to encourage construction contractors to apply for funding that would <br />enable owners of eligible fleets to purchase low- emission heavy -duty engine technologies to achieve near - <br />term reduction of NO, emissions from in -use, off -road diesel vehicles. These fleet upgrades are in <br />furtherance of the State "Surplus Off -road Opt -in for NO,," (SOON) provision of a recently adopted <br />California ARB regulation, which sets more - stringent NO, emission targets for in -use, off -road diesel <br />vehicles. In 2008, the AQMD Board approved setting aside up to $120 million over a four year period <br />for this purpose called the "SOON" Program.. The current funding period closed June 4, 2010. This EIR <br />is both a programmatic level document for the Transit Zoning Code, as well as a project specific analysis <br />for the Development Project for the Redevelopment Agency parcels. With both the current funding <br />cycle for the SOON Program having closed and therefore not available for the near -term Development <br />Project, and the unknown status of future funding for projects that have not yet been identified, it is not <br />feasible to add specific mitigation measures relating to SOON Program funding.
