La~;~ - ~t-y City Attorney <br />QUESTION: May the City Council discuss in executive <br />session the question of whether to grant <br />compensation for services to members of <br />City boards and commissions? <br />~?#NSWF~R: No, no± to discuss salary scales in general. <br />However, the Council may discuss the quali- <br />fications of any individual member in execu- <br />tive session. <br />ANALYSIS: <br />Section 54957 of the Government Code, which forms a <br />section of the chapter generally referred to as the "Brown Act" <br />reads in part as follows: <br />"Nothing in this Chapter shall be construed to <br />prevent the legislative body of a local agency <br />... from holding executive sessions during a <br />regular or special meeting to consider the <br />appointment, employment or dismissal of a public <br />officer or employee or to hear complaints or <br />charges brought against such officer or employee <br />by another public officer, person, or employee <br />~a.nless such officer or employee requests a public <br />hearing...." <br />The purpose of this "personnel exception" to the <br />general requirement laid down by the Brown Act of open and pub- <br />1i.c meetings has been sttzt.n~i in an opinion of the State Attorney <br />General as follows.: <br />"The purpose of Section 54957 is to protect indi- <br />vidual.. puhlir e!~~~>loyc~ers gird officers from . <br />121 <br />
