CITY OF SANTA ANA INSTRUCTION FOR CERTIFICAT ION 1. By signing and submitting th is proposa l , the prospective recipient of Federa l assistance funds is providin g t11 e certifi cation as set out be low. 2. The certification in this cl ause is a material representation of fact upon wh ich re liance was placed when this transaction was entered into. If it is later determined that the prospective recip ient of Federal assistance funds knowing ly rendered an erroneous certification, in addition to other remedies avai l ab le to th e Federa l Government , the Depa rtm ent of Labor (DO L) may pursue avai labl e remedies , in clud ing suspension and /or debarment. 3. The pr ospective recipient of Federa l assistance funds shall provide immediate written notice to the person to whom this proposa l is submitted if at any time the prospective recipient of Federal assistance funds l earns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances. 4. The terms "covered transaction", "debarment", "suspended", "ineligib l e", "lower tier covered transaction", "pa rticipant", "person ", "primary covered transaction", "p rinciple", "proposa l", and "vo l untari ly excluded", as used in this cause, have the meanings set out in the Definitions and Coverage sections of ru les implemen ting Executive Order 12549. You may contact the person to whom this proposa l is subm itted for assistance in obtaining a copy of those regu l ations. 5. The prospective recipient of Federa l assistance funds agrees by submitting this proposa l that , shou ld the proposed covered transaction be entered into , it shall not knowing ly enter into any lower tier covered t ransaction with a person who is debarred, suspended, declared inel igibl e, or vo l untari ly ex cl uded from participation in this covered transaction , un less authorized by the DO L. 6. The prospective recipient of Federal assistance funds ag rees by submitting this proposa l, that it will incl ude the cl ause ti tl e "C ertification Regarding Debarment, Suspension , Inel igib le , or vo luntaril y exclud ed" from the covered transaction un less it knows that the certification is erroneous. 7. Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render in good faith the ce r tification required to exceed that which is normally possessed by a prudent person in the ord inary course of business dea lings. 8. Except for transactions authorized under paragraph 5 of these instructions, if a participant in a covered transaction knowing ly enters into a lower tier covered tran saction with a person who is suspended, debarred, ine ligible, or vo lunt ary excluded from partic ipation in this transaction , in addition to other remedies avai labl e to the Federal Government. the DO L may pursue avai lab le remedies , including suspens ion and /or debarment.
