CITY OF SANTA ANA ATTACHMENT U CERTI FICATION REGARD I NG LOBBY I NG The undersigned certifi es , to the best of his or her knowledge and be l ief, that: 1) No Federal appropriated funds have been paid or wi ll be paid, by or on beha lf of the undersigned, to any perso n for influ e ncing or attempting to influ ence a n officer or em ployee of any organization , a Member of Co ngress in connection with the awarding of any Federa l contract, the m aking of any Federa l grant, t he mak ing of any Federal loan , the ente ring in to of any cooperative agreement, and t he extension , cont inuation, renewa l , amendment, or modification of any Federa l co ntract, g rant, loa n, or coope rativ e ag reement. 2) If any f unds other than Federa l appropriated fun ds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any organization, a Member of Congress, an officer or employee of Congress, or an emp loyee of a member of Co ng ress in con nection with this Federal contract, grant, loan , or cooperative agreement, the undersigned s hall comp lete and submi t Standard Form -LLL , "Di sclos ure Form to Report L obbying ." in accordance with its instructions. 3) The undersigned sha ll requ ire that the language of this certification be in cl uded in the award documents for all subawards at all tiers (in cl uding agreements) and that all subrecipient's shall certify and discl ose according ly. This certifica ti on is a material representation of fact upon which re liance was pl aced when this transa ction was made or entered into. Subm iss ion of this certification is a prerequisite for making or entering into this transaction imposed by 31 U.S.C. 1352 . Any pe rson who fai ls to fil e the required certification shall be subject to a civi l pena lty of not l ess than $10,000 and not more than $100,000 for each such fai lure occurri ng on or before Octobe r 23 , 1996, and of n ot less than $11 ,000 and not more th an $110,000 for each such fai lure.
