Unit 600 has been continuously occupied by various tenants for office purposes since the building's original construction. Child Guidance Center relocated to and has been operating medical offices in Unit 600 without a CUP since 2023. Their office operations in Units 202 and 205 also began in 2023. Currently, Child Guidance Center does not possess active certificates of occupancy from the City for any of the three units located at 600 W. Santa Ana Boulevard because the certificate for Unit 600 requires CUP approval first. While the other two could potentially be obtained now, the applicant is awaiting CUP approval for Unit 600 before obtaining all certificates simultaneously. On December 20, 2022, the City Council approved urgency Ordinance No. NS-3035, amending various sections of Chapter 41 (Zoning) of the SAMC, including Section 41- 313.5. Subsequently, on February 7, 2023, Ordinance No. NS-3038 was approved by City Council, amending portions of Chapter 41 (Zoning) of the SAMC, including Section 41-313.5. The two aforementioned ordinances amended Section 41-313.5 to require medical offices operated by government, government-subsidized, not-for-profit, or philanthropic entities to obtain approval of a CUP prior to operating. On October 29, 2024, the applicant submitted a Development Project Review (DP) application to change the use of the existing sixth floor, unit 600, to medical office operated by Child Guidance Center. The City’s Development Review Committee (DRC) completed review of the DP application on December 2, 2024, and, subsequently, on January 23, 2025, the applicant submitted the subject CUP application.
