Unit 600 has been continuously occupied by various tenants for <br />office purposes since the building's original construction. Child Guidance Center <br />relocated to and has been operating medical offices in Unit 600 without a CUP since <br />2023. Their office operations in Units 202 and 205 also began in 2023. Currently, Child <br />Guidance Center does not possess active certificates of occupancy from the City for any <br />of the three units located at 600 W. Santa Ana Boulevard because the certificate for Unit <br />600 requires CUP approval first. While the other two could potentially be obtained now, <br />the applicant is awaiting CUP approval for Unit 600 before obtaining all certificates <br />simultaneously. <br /> <br />On December 20, 2022, the City Council approved urgency Ordinance No. NS-3035, <br />amending various sections of Chapter 41 (Zoning) of the SAMC, including Section 41- <br />313.5. Subsequently, on February 7, 2023, Ordinance No. NS-3038 was approved by <br />City Council, amending portions of Chapter 41 (Zoning) of the SAMC, including Section <br />41-313.5. The two aforementioned ordinances amended Section 41-313.5 to require <br />medical offices operated by government, government-subsidized, not-for-profit, or <br />philanthropic entities to obtain approval of a CUP prior to operating. <br />On October 29, 2024, the applicant submitted a Development Project Review (DP) <br />application to change the use of the existing sixth floor, unit 600, to medical office <br />operated by Child Guidance Center. The City’s Development Review Committee (DRC) <br />completed review of the DP application on December 2, 2024, and, subsequently, on <br />January 23, 2025, the applicant submitted the subject CUP application. <br />
