CHAPTER 5 <br />LESS -THAN -SIGNIFICANT ENVIRONMENTAL <br />EFFECTS WITH MITIGATION INCORPORATED <br />Based on the Supplemental EIR, the Project would have less -than -significant environmental <br />effects with mitigation incorporated for the specific areas associated with the topics identified <br />below. <br />5.1 AIR QUALITY <br />Threshold AQ-1: The Project would not conflict with or obstruct implementation of the <br />applicable air quality plan with the implementation of mitigation. <br />Findings: The City finds that changes or alterations have been required in, or incorporated into, <br />the Project, which avoid or substantially lessen the significant environmental effect as identified <br />in the Final Supplemental EIR. Specifically, the City finds that the following mitigation measure <br />shall be implemented to reduce potentially significant air quality impacts resulting from the Project <br />(Draft Supplemental EIR, p. 4.1-40): <br />Project -Specific MM AQ-1: Prior to the issuance of occupancy permits, the Planning <br />Division shall confirm that the proposed project's Covenants, Conditions, and Restrictions <br />(CC&Rs) and/or tenant lease agreements include contractual language that all <br />landscaping equipment used on -site shall utilize at least 50 percent electric landscaping <br />equipment (e.g., lawnmowers, leaf blowers, hedge trimmers). All residential and non- <br />residential properties shall be equipped with exterior electrical outlets to accommodate <br />this requirement. This requirement shall be included in the third -party vendor agreements <br />for landscape services for the building owner and tenants, as applicable. <br />Additionally, the City finds that the Project will implement the following regulatory requirements <br />RR AQ-1 through RR AQ-3 (Draft Supplemental EIR, pp. 4.1-8 — 4.1-9): <br />RR AQ-1: New buildings are required to achieve the current California Building Energy <br />Efficiency Standards (Title 24, Part 6) and California Green Building Standards Code <br />(CALGreen) (Title 24, Part 11). The 2019 Building Energy Efficiency Standards became <br />effective January 1, 2020. The Building and Energy Efficiency Standards and CALGreen <br />are updated tri-annually with a goal to achieve net zero buildings energy for 2030. <br />RR AQ-2: Construction activities will be conducted in compliance with California Code of <br />Regulations, Title 13, Section 2449, which requires that nonessential idling of construction <br />equipment is restricted to five minutes or less. <br />RR AQ-3: Construction activities will be conducted in compliance with any applicable <br />South Coast Air Quality Management District rules and regulations, including but not <br />limited to: <br />City of Santa Ana The Village Santa Ana Specific Plan Project <br />August 2025 CEQA Findings of Fact and Statement of Overriding Considerations <br />5-1 <br />
