MEMORANDUM OF UNDERSTANDING <br /> BETWEEN THE CITY OF SANTA ANA AND <br /> THE SANTA ANA POLICE BENEVOLENT ASSOCIATION <br /> FOR FISCAL YEARS 1985-86 AND 1986-87 <br /> ARTICLE I - RECOGNITION <br /> Pursuant to the provision of the Meyers-Millias-Brown Act, Government <br /> Code Section 3500, et seq., the City of Santa Ana (hereinafter called the, <br /> "City") has recognized the Santa Ana Police Benevolent Association (herein <br /> called the "Association") as the recognized representative of the <br /> bargaining unit which includes police department employees in the sworn, <br /> "safety-member" classifications and assignments of Police Officer, Senior <br /> Police Officer, Police Sergeant, Senior Police Sergeant and in the <br /> non-sworn, "miscellaneous-member" classifications and assignments of Animal <br /> Control Officer I and II, Community Service Officer, Criminalist I, II, <br /> III, Criminalistics Laboratory Aide, Police Communications Supervisor, <br /> Evidence and Property Clerk, Forensic Specialist I and II, Parking Control <br /> Officer, Police Recruit, Police Service Officer, Police Services <br /> Dispatcher, and Senior Forensic Specialist and excludes all other non-sworn <br /> employees of the Police Department and sworn, "safety-member" police <br /> classes of Police Lieutenant, Police Captain, Deputy Chief of Police and <br /> Police Chief. <br /> ARTICLE II - NON-DISCRIMINATION CLAUSE <br /> Section 1. The City and Association agree that they shall not <br /> discriminate against any employee because of race, color, sex, age, <br /> national origin, political or religious opinions or affiliations, or in <br /> violation of Government Code Sec. 3500. The City and the Association shall <br /> reopen any provision of this Agreement for the purpose of complying with <br /> any order of a Federal or State agency or court of competent jurisdiction <br /> requiring a modification or change in any provisions of this Agreement in <br /> compliance with State or Federal anti-discrimination laws. <br /> Section 2. Whenever reference is made to the masculine gender it <br /> shall be understood to include the feminine gender, unless expressly stated <br /> otherwise. <br /> ARTICLE III - ATTENDANCE, WORKDAY AND WORKWEEK <br /> Section 1. Attendance. Employees covered by this Agreement shall be <br /> in attendance at their work during hours prescribed by the Chief of Police <br /> or his designee(s) and shall not absent themselves during prescribed hours <br /> without approval of the Chief of Police or his designee(s). <br /> Section 2.
