ARTICLE XIV - RELEASE TIME FOR ASSOCIATION REPRESENTATIVE. <br /> During the term of this Agreement, the City agrees to grant full-time <br /> release from duty for one (1) Association representative for the conduct of <br /> association affairs subject to the following: <br /> Section 1. The Association shall reimburse the City for one <br /> hundred percent (100%) of salary (including any salary additives, such as <br /> career incentive pay) and benefit costs. Such reimbursement may be from <br /> the bank established pursuant to Section 15 of Article VIII of this <br /> Agreement. <br /> Section 2. The Association shall provide an insurance policy or <br /> policies, or certificate of such insurance, naming the City of Santa Ana, <br /> its officers, employees and agents as insured or additional insured, which <br /> provides coverage against liability for any and all claims and/or suits for <br /> damages or injuries to persons or property resulting from or arising out of <br /> any act or ommission of said Association representative. Said policy or <br /> policies of insurance shall provide coverage for both bodily injury and <br /> property damage in not less than the following minimum amounts: One <br /> Million Dollars ($1,000,000.00) combined single limit or its equivalent. <br /> Said policy or policies shall also contain a provision that no termination, <br /> cancellation or change or coverage of insured or additional insured shall <br /> be effective until thirty (30) days notice thereof has been given in <br /> writing to the City of Santa Ana. <br /> Section 3. The Association shall provide the City of Santa Ana <br /> with an insurance certificate from a workers' compensation insurance <br /> carrier certifying that it carries primary workers' compensation insurance <br /> on behalf of said Association representative and the policy shall not be <br /> cancelled nor the coverage reduced except upon ten (10) days prior notice <br /> to the City of Santa Ana. <br /> Section 4. The Association shall indemnify and save harmless the <br /> City of Santa Ana, its officers and employees, from and against any and all <br /> damage to property or injuries to or death of any person or persons, <br /> including property and employees or agents of the City of Santa Ana, and <br /> shall defend, indemnify and save harmless the City of Santa Ana, its <br /> officers and employees, from any and all claims, demands, suits, actions or <br /> proceedings of any kind or nature, including, but not by way of limitation, <br /> workers' compensation claims, resulting from or arising out of the <br /> negligent acts, errors, or omissions, or arising out of the intentional or <br /> malicious acts of Association's representative. <br /> Section 5. The Association and the City of Santa Ana agree that <br /> Association's representative will not be required to carry out any peace <br /> officers' duties during such time that Association's representative is on <br /> such full-time release from duty. The Association's representative will be <br /> required to comply with the Rules and Regulations of the Santa Ana Police <br /> Department as they apply to off-duty employees, except such representative <br /> 28 <br />
