will not be required to report for duty for any purpose. <br /> Section 6. Upon return to duty from such full—time release, the <br /> Association's representative shall be restored to the same position without <br /> loss of any benefits as he or she would have occupied or accrued if there <br /> had been no disruption in duty status. <br /> ARTICLE XV A SAFETY. <br /> The City and the Employees of the City agree to comply with all <br /> applicable federal, state and local laws, and City of Santa Ana <br /> regulations, which relate to health and safety. <br /> ARTICLE XVI - RESIDENCY. <br /> Section 1. Employees covered by this Agreement are permitted to <br /> reside outside the limits of Orange County, so long as such residency is <br /> not an unreasonable distance from, not requires an unreasonable response <br /> time to, the particular employee's place of employment. <br /> A. Any employee desiring to take advantage of the opportunity to <br /> reside outside of Orange County shall first request permission to do so <br /> from the Chief of Police. Said request shall be granted by the Chief of <br /> Police if he determines the intended residence is not an unreasonable <br /> distance from and/or does not required an unreasonable response time to the <br /> employee's place or employment. <br /> B. If the Chief of Police refuses said request, the employee <br /> shall have a right to appeal said determination to the City Manager. <br /> ARTICLE XVII - DISCIPLINE <br /> Section 1. Any permanant employee covered by this Agreement may only <br /> be disciplined in accordance with the standards and procedures and subject <br /> to all rights of appeal set forth in Santa Ana Municipal Code Sections 9-9, <br /> 9-10, 9-118.1, et seq. Any probationary employee covered by this Agreement <br /> may be disciplined in accordance with the standards and procedures set <br /> forth in Santa Ana Municipal Code Sections 9-90, 9-91, 9-18, and subject to <br /> review in accordance with the grievance review procedure contained in this <br /> Agreement. <br /> Section 2. In addition, a new section shall be added to the Municipal <br /> Code to provide as follows: <br /> A. In the event an employee is ordered to absent himself from <br /> the job based on probable cause and it is subsequently determined by the <br /> Department Head, the City Manager, Personnel Board or a court of competent <br /> jusisdiction, that cause did not exist for the ordered absence, the <br /> employee shall have restored to him any paid leaves of absence against <br /> which such absence may have been charged, and he shall be granted a <br /> retroactive leave of absence with pay for the time during which he was <br /> prohibited from performing the duties of his position, less any <br /> 29 <br />
