Section 9. One-Year Highest Com ensation Option. The City shall amend <br /> its contract with the P.E.R.S. in order to provide, effective July 1 , 1985, <br /> the "one-year highest compensation" option (Section 20024.2 of the Public <br /> Employee's Retirement Law) for all safety-members of the Association so that, <br /> for such members retiring on or after said date, the period for determining <br /> average salary when retirement allowances are computed would be changed from <br /> the current 36 highest paid consecutive months to the 1a highest paid <br /> consecutive months. <br /> ARTICLE XIV - RELEASE TiNE_FQB-ASSOCIATION REPRESENTATIVE. <br /> During the term of this Agreement, the City agrees to grant full-time <br /> release from duty for one (1 ) Association representative for the conduct of <br /> association affairs subject to the following: <br /> Section 1 . The Association shall reimburse the City for one hundred <br /> percent (100%) of salary (including any salary additives, such as career <br /> incentive pay) and benefit costs. Such reimbursement may be from the bank <br /> established pursuant to Section 15 of Article VIII of this Agreement. <br /> Section 2. The Association shall provide an insurance policy or <br /> policies, or certificate of such insurance, naming the City of Santa Ana, its <br /> officers, employees and agents as insured or additional insured, which <br /> provides coverage against liability for any and all claims and/or suits for <br /> damages or injuries to persons or property resulting from or arising out of <br /> any act or omission of said Association representative. Said policy or <br /> policies of insurance shall provide coverage for both bodily injury and <br /> property damage in not less than the following minimum amounts: One Million <br /> Dollars ($1,000,000.00) combined single limit or its equivalent. Said policy <br /> or policies shall also contain a provision that no termination, cancellation <br /> or change of coverage of insured or additional insured shall be effective <br /> until thirty (30) days notice thereof has been given in writing to the City of <br /> Santa Ana. <br /> S i 3. The Association shall provide the City of Santa Ana with <br /> an insurance certificate from a workers' compensation insurance carrier <br /> certifying that it carries primary workers' compensation insurance on behalf <br /> of said Association representative and the policy shall not be cancelled nor <br /> the coverage reduced except upon ten (10) days prior notice to the City of <br /> Santa Ana. <br /> Section k. The Association shall indemnify and save harmless the <br /> City of Santa Ana, its officers and employees, from and against any and all <br /> damage to property or injuries to or death of any person or persons, including <br /> property and employees or agents of the City of Santa Ana, and shall defend, <br /> indemnify and save harmless the City of Santa Ana, its officers and employees, <br /> from any and all claims, demands, suits, actions or proceedings of any kind or <br /> nature, including, but not by way of limitation, workers' compensation claims, <br /> resulting from or arising out of the negligent acts, errors, or omissions, or <br /> arising out of the intentional or malicious acts of Association's <br /> representative. <br /> Section 5.
