. Association's representative will not be required to carry out any peace <br /> officers' duties during such time that Association's representative is on such <br /> full-time release from duty. The Association's representative will be <br /> required to comply with the Rules and Regulations of the Santa Ana Police <br /> Department as they apply to off-duty employees, except such representative <br /> will not be required to report for duty for any purpose. <br /> Section 5. Upon return to duty from such full-time release, the <br /> Association's representative shall be restored to the same position without <br /> loss of any benefits as he or she would have occupied or accrued if there had <br /> been no disruption in duty status. <br /> ARTICLE XV .SAFETY.. <br /> The City and the employees of the City agree to comply with all <br /> applicable federal, state and local laws, and City of Santa Ana regulations, <br /> which relate to health and safety. • <br /> ARTICLE XVI - RESIpENCY. <br /> Section 1.. Employees covered by this Agreement are permitted to reside <br /> outside the limits of Orange County, so long as such residency is not an <br /> unreasonable distance from, nor requires an unreasonable response time to, the <br /> particular employee's place of employment. <br /> A. Any employee desiring to take advantage of the opportunity to <br /> reside outside of Orange County shall first request permission to do so from <br /> the Chief of Police. Said request shall be granted by the Chief of Police if <br /> he determines the intended residence is not an unreasonable distance from <br /> and/or does not require an unreasonable response time to the employee's place <br /> of employment. <br /> B. If the Chief of Police refuses said request, the employee shall <br /> have a right to appeal said determination to the City Manager. <br /> ARTICLE XVII —DISCIPLINE, <br /> Section 1 . Any permanent employee covered by this Agreement may only be <br /> disciplined in accordance with the standards and procedures and subject to all <br /> rights of appeal set forth in Santa Ana Municipal Code Sections 9-9, 9-10, <br /> 9-118.1 et seq. Any probationary employde covered by this Agreement may be <br /> disciplined in accordance with the standards and procedures set forth in Santa <br /> Ana Municipal Code Sections 9-90, 9-91 and 9-18, and subject to review in <br /> accordance with the grievance review procedure contained in this Agreement. <br /> Section 2. In addition, a new section shall be added to the Municipal <br /> Code to provide as follows: <br /> A. In the event an employee is ordered to absent himself from the <br /> job based on probable cause and it is subsequently determined by the <br /> Department Head, the City Manager, Personnel Board or a court of competent <br /> 28 <br />
