MEMORANDUM OF UNDERSTANDING <br /> BETWEEN THE CITY OF SANTA ANA AND <br /> THE SANTA ANA POLICE BENEVOLENT ASSOCIATION <br /> FOR FISCAL YEARS 1981-82 AND 1982-83 <br /> ARTICLE I - RECOGNITION <br /> Pursuant to the provision of the Meyers-Milias-Brown Act, Government <br /> Code Section 3500, et seq. , the City of Santa Ana (hereinafter called the "City") <br /> has recognized the Santa Ana Police Benevolent Association (hereinafter called <br /> the "Association") as the recognized representative of the bargaining unit which <br /> includes police department employees in the classifications and assignments of <br /> Police Officer , Senior Police Officer, Police Sergeant, Senior Police Sergeant, <br /> Animal Control Officer I and II, Assistant Criminalist, Community Service Officer, <br /> Criminalist, Evidence and Property Clerk, Forensic Specialist I and II , Parking <br /> Control Officer, Police Recruit, Police Service Officer, Police Services Dispatcher, <br /> and Senior Forensic Specialist and excludes all other non-sworn employees of the <br /> Police Department and sworn, "safety-member" police classes of Police Lieutenant, <br /> Police Captain, Police Commander and Police Chief. <br /> ARTICLE II -NON-DISCRIMINATION CLAUSE <br /> Section 1 . The City and Association agree that they shall not discriminate <br /> against any employee because of race, color, sex, age, national orgin, political <br /> or religious opinions or affiliations. The City and the Association shall reopen <br /> any provision of this Agreement for the purpose of complying with any order of a <br /> Federal or State agency or court of competent jurisdiction requiring a modification <br /> or change in any provisions of this Agreement in compliance with State or Federal <br /> anti-discrimination laws. <br /> Section 2. Whenever reference is made to the masculine gender it shall be <br /> understood to include the feminine gender, unless expressly stated otherwise. <br /> ARTICLE III - ATTENDANCE, WORKDAY AND WORKWEEK <br /> Section 1. Attendance. Employees covered by this Agreement shall be in <br /> attendance at their work during hours prescribed by the Chief of Police or his <br /> designee(s) and shall not absent themselves during prescribed hours without <br /> approval of the Chief of Police or his designee(s) . <br /> Section 2. Definitions. <br /> A. Workday. Eight (8) hours of work shall constitute a regular and <br /> normal workday for all employees. The regular and normal workday for sworn, <br /> "safety-member" police personnel assigned to Traffic and Patrol shall be a tour of <br /> duty of eight and one-half (8 1/2) hours with one-half (1/2) hour for meals (Code <br /> 7 time) and for all others nine (9) hours with one (1) hour for Code 7 time, <br /> which Code 7 time shall not be considered overtime and is not otherwise compensable <br /> except as provided in the Settlement Agreement executed by the parties hereto on <br /> November 21, 1977, and including Field Operations Divisional Order No. 15, dated <br /> February 15, 1978, and attached to said Settlement Agreement as "Exhibit A." <br /> B. Minimum Workweek . The minimum workweek for all <br /> employees covered by this Agreement shall consit of forty (40) <br /> hours . <br /> -1- <br />
