MEMORANDUM OF UNDERSTANDING <br /> BETWEEN THE CITY OF SANTA ANA AND <br /> THE SANTA ANA POLICE BENEVOLENT ASSOCIATION <br /> ARTICLE I - RECOGNITION <br /> Pursuant to the provision of the Meyers-Milias- <br /> Brown Act, Government Code Section 3500, et seq. , the City <br /> of Santa Ana (hereinafter called the "City") has recognized <br /> the Santa Ana Police Benevolent Association (hereinafter <br /> called the "Association" ) as the recognized representative <br /> of the bargaining unit which includes police department <br /> employees in the classifications and assignments of Patrol- <br /> man, Policewoman, Senior Police Officer, Police Sergeant, <br /> Senion Police Sergeant, (Police) Emergency Services Dispatcher, <br /> Animal Control man, Assistant Animal Control Man, Police <br /> Service Officer, Evidence and Property Technician, Community <br /> Service Officer, I.D. Technician, Assistant I.D. Technician, <br /> Criminalist, Assistant Criminalist, and Parking Control <br /> Officer and excludes all other non-sworn police department <br /> employees and sworn classifications of Police Lieutenant, <br /> Police Captain, Deputy Chief of Police and Chief of Police. <br /> ARTICLE II •-• NON-DISCRIMINATION CLAUSE <br /> Section 1. The City and Association agree that they <br /> shall not discriminate against any employee because of race, <br /> color, sex, age, national origin, political or religious <br /> opinions or affiliations. The City and the Association <br /> shall reopen any provision of this Agreement for the purpose <br /> of complying with any order of a Federal or State agency or <br /> court of competent jurisdiction requiring a modification or <br /> change in any provisions of this Agreement in compliance <br /> with State or Federal anti-discrimination laws. <br /> Section 2 . Whenever reference is made to the mascu- <br /> line gender it shall be 'understood to include the feminine <br /> gender, unless expressly stated otherwise. <br /> ARTICLE III •- ATTENDANCE, WORKDAY AND WORKWEEK <br /> Section 1." Attendance. Employees covered by this <br /> Agreement shall be in attendance at their work during hours <br /> prescribed by the Chief of Police or his designee (s) and <br /> shall not absent themselves during prescribed hours without <br /> approval of the Chief of Police or his designee (s) . <br /> -1- <br />
